' 93CW159 of District Court, Water Division No. 1, and is contained in
the original permit amendment application, which was submitted to the
DMG on July 1, 1999. The Southdown-Reservoir storage and
associated water rights aze the responsibility of Southdown as property
' owne%
~ Detailed design specifications will be developed closer to the time
~~-~ when these reservoirs will be constructed and appropriate design
approvals will be obtained from those local and state agencies with
regulatory oversight of water storage structures.
13. Comment: On Table 2 titled, Post-Mining Reclamation Table, acreages of vazious
' land uses are listed. Due to the complexity of the mining and reclamation
plan, it would be helpfiil for the Division during its review of the
application to have a list of the following acreages both prior to
disturbance (existing conditions) and during final reclamation: unlined
ponds, lined ponds, lined water storage reservoirs, open or ground
water-fed lakes, wetlands or marsh azeas, riparian canes, subirrigated
meadows, and upland meadows. The number of lined water structures
and lineaz feet of slurry wall or acreage of liner to be constructed would
also be helpful. The applicant may revise Table 2 or provide a new table
i
h
d i
Pl
d
h
f
i
w
t
e requeste
ormat
on.
ease respon
.
t
n
Response: The post mining reclamation table is provided to give the DMG a
' general idea of the basic distribution of the reclaimed lands associated
with the amended mining and reclamation plan. Specific acreages
' requested by the Division cannot be provided by WMI beyond what the
Company has previously submitted to the DMG.
The Lyons amendment describes two reclamation methods available
to the Company for purposes of limiting the flow of groundwater into
the mined out pit and for purposes of creating sealed water storage
Th
t
f
i
fi
d
f
d
h
d i
h
t
d
pre
compac
reservo
rs.
e
rs
an
erre
met
o
s t
e use o
e
backfill of clay, shale, and overburden. Please see Attachment #5, Item
#2, Memorandum from Tom Schreiner to Erica Crosby dated November
4, 1999. In the alternative, should the compacted backfill method prove
' ineffective in a given azea of the pit, WMI will use the slurry seal
method to limit groundwater movement.
