Mr. Randy Spencer <br />Ms. Susan Mowry <br />August 1, 1985 <br />• E.5 <br />Page Five <br />Bear Coal Company stated that they also had the Annual <br />Hydrologic Report, although, they admitted that they had not <br />covered all parameters that were included in stipulation <br />No. 6. Bear Coal Company agreed that the report will be <br />completed and submitted to the Division as required. It was <br />suggested at this time that since both stipulation No. 4 <br />and stipulation No. 6 were annual reports, that the Mine <br />Usage and Inflow Report could be submitted within the Annual <br />Hydrologic Report. This was agreed to by the Division. <br />• E.6 <br />The Division stated that quarterly Pond and inspection <br />Reports need to be kept on file by the Bear Coal Company, <br />although they do not necessarily need to be submitted to the <br />Division. Bear Coal Company agreed to quarterly Pond <br />Inspections and also agreed to keep them on file and <br />available to the Division during inspections for both the <br />sediment pond at Bear Mine No. 3 and sediment pond No. 3 at <br />Bear Mine No. 2. <br />• E.7 <br />The Bear Coal Company did not understand why flow data <br />needed to be required from Lone Pine Gulch. Susan stated <br />that she did not know either but that it was in the Bear <br />Coal Permit. It was agreed that data may not need to be <br />collected and a minor revision could be submitted to the <br />Division to clear up this confusion. <br />• E.8 <br />Bear Coal Company agreed to have the gated pipe installed as <br />a principal spillway on Sediment Pond No. 4 reviewed as to <br />applicability of its intended use. <br />• F.1 <br />Bear Coal Company agreed that after the survey of the Bear <br />No. 1 and No. 2 Mines to ascertain responsibility of the <br />area between Bear Coal Company and the West Elk Coal Company <br />(ALCO), that a time table would be set up for conducting <br />transplanting in the area. <br />
