Mr. Randy Spencer <br />Ms. Susan Mowry <br />August 1, 1985 <br />C.1 <br />Page Three <br />The Bear Company agreed to provide a new updated map of the <br />Bear No. 3 facility site which will include the following <br />information: <br />• Disturbed Acres <br />• Acres Striped of Topsoil <br />• Acres Utilized for Topsoil Storage <br />In addition, Bear Coal Company can provide volumes of <br />topsoil removed, stored, and topsoil which will be replaced <br />on the disturbed areas. <br />An additional map will be provided for the Bear No. 1 and <br />Bear No. 2 reclaimed area. This map will include the <br />following information: <br />• The location of Highway 133 and river relocation <br />• Area controlled and/or disturbed by West Elk Coal <br />Company (ARCO) <br />• Area of Bear Coal Company reclamation responsibility <br />C.2 <br />Bear Coal Company will test the sediment removed from the <br />sediment pond, and if this material is not suitable to be <br />used as soil material, a plan will be developed for disposal <br />of sediment. At final reclamation, this material may be <br />used as backfill during reclamation activities. <br />C.3 <br />The Bear Coal Company stated in the meeting that they did <br />not believe that Bear No. 1 and No. 2 mines were part of the <br />Bear No. 3 permit. Susan said that she would check this out <br />and get back to Bear Coal Company with a reply. Meanwhile, <br />the Bear Coal Company has agreed to survey the Bear No. 1 <br />and No. 2 area and to provide a map and legal description of <br />the area used by Bear Coal Company and that area used by the <br />West Elk Coal Company (ARCO). This new legal description <br />would be used in the new bond calculation and any subsequent <br />bond release. <br />
