RULE 41: PERMITS FOR SPEC OPERATIONS .
Ill . 4. 1 Application for a special permit will be required for any sand ,
gravel , or quarry aggregate operation which is to be operated for the
sole purpose of obtaining materials for highway, road, utility, or
similar-type construction under a federal • state , county, city, town ,
or special district contract where the contract calls for work to be
commenced within a specifically short time and which will affect ten
acres or less. The operator shall submit two copies of the applica-
tion form, all attachments and maps , as outlined in Section 4. 11 . All
tests, analyses , surveys and maps shall be prepared by qualified
persons. All information submitted in an application must be accurate
and complete, and acknowledged as such by the signature of an auth-
orized individual on an application form provided by the Board.
4. 11 The application shall contain:
111 (3) (a) (1) The address of the general office and the local address
or addresses of the operator,
111 (3) (b) (2) The name of the owner of the surface of the affected land,
111 (3) (c) (3) The name of the owner of the subsurface rights of the
affected land,
I11 (3) ( i) (4) A letter from the local government specifying conformance
with existing zoning regulations,
112(2) (b) (5) A map showing information sufficient to determine the
location of the affected land on the ground and existing
and proposed roads or access routes to be used in connec-
tion with the mining operation. Names of all immediately
adjacent surface owners of record shall also be shown,
112(3) (d) (6) Legal description (to the nearest quarter quarter section)
® and approximate size of the affected land,
112(3) (e) (7) Information sufficient to describe or identify the type .
of mining operation proposed and how it would be con-
ducted.
111 (2) (d) (8) Reclamation costs : application shall include surety or
bond in the amount of two thousand five hundred dollars
per acre;
(9) The application shall include, but not necessarily be
limited to, narratives to describe the following :
a. Wildlife - present occurrence, if any, and seasonal
use by game and non-game species.
b. Water Resources - occurrence of surface water drainage
on affected lands and ground water presence , if any.
c. Vegetation - If vegetation is a part of the reclamation
plan, description of present vegetation on affected land
namina types and estimated cover.
d. Soils - If vegetation is a part of the reclamation plan,
a description of soils on the affected land. In its
discretion, the Board may request soil analyses information.
