RULE 41: PERMITS FOR SPEC OPERATIONS . <br /> Ill . 4. 1 Application for a special permit will be required for any sand , <br /> gravel , or quarry aggregate operation which is to be operated for the <br /> sole purpose of obtaining materials for highway, road, utility, or <br /> similar-type construction under a federal • state , county, city, town , <br /> or special district contract where the contract calls for work to be <br /> commenced within a specifically short time and which will affect ten <br /> acres or less. The operator shall submit two copies of the applica- <br /> tion form, all attachments and maps , as outlined in Section 4. 11 . All <br /> tests, analyses , surveys and maps shall be prepared by qualified <br /> persons. All information submitted in an application must be accurate <br /> and complete, and acknowledged as such by the signature of an auth- <br /> orized individual on an application form provided by the Board. <br /> 4. 11 The application shall contain: <br /> 111 (3) (a) (1) The address of the general office and the local address <br /> or addresses of the operator, <br /> 111 (3) (b) (2) The name of the owner of the surface of the affected land, <br /> 111 (3) (c) (3) The name of the owner of the subsurface rights of the <br /> affected land, <br /> I11 (3) ( i) (4) A letter from the local government specifying conformance <br /> with existing zoning regulations, <br /> 112(2) (b) (5) A map showing information sufficient to determine the <br /> location of the affected land on the ground and existing <br /> and proposed roads or access routes to be used in connec- <br /> tion with the mining operation. Names of all immediately <br /> adjacent surface owners of record shall also be shown, <br /> 112(3) (d) (6) Legal description (to the nearest quarter quarter section) <br /> ® and approximate size of the affected land, <br /> 112(3) (e) (7) Information sufficient to describe or identify the type . <br /> of mining operation proposed and how it would be con- <br /> ducted. <br /> 111 (2) (d) (8) Reclamation costs : application shall include surety or <br /> bond in the amount of two thousand five hundred dollars <br /> per acre; <br /> (9) The application shall include, but not necessarily be <br /> limited to, narratives to describe the following : <br /> a. Wildlife - present occurrence, if any, and seasonal <br /> use by game and non-game species. <br /> b. Water Resources - occurrence of surface water drainage <br /> on affected lands and ground water presence , if any. <br /> c. Vegetation - If vegetation is a part of the reclamation <br /> plan, description of present vegetation on affected land <br /> namina types and estimated cover. <br /> d. Soils - If vegetation is a part of the reclamation plan, <br /> a description of soils on the affected land. In its <br /> discretion, the Board may request soil analyses information. <br /> - 29 - <br />
