Cattany: <br />This letter aclatowledges the Office of Surface Mining (OSM), Western Region (WR), <br />Denver Field Division`s (DFD) receipt and review of the above Phase III Bond Release <br />Proposed Decision document prepazed by the Division of Minerals and Geology (DMG) <br />dated May 16, 2006. DFD agrees with the findings in the decision document and hereby <br />provides OSM concurrence for the above bond release action in accordance with 30 CFR <br />740.1 S (d) (3), and 30 CFR 906.30, Article L~(, Section 24, of the State-Federal <br />Cooperative Ageement. ~ ~ .. , . <br />A thorough summary of previous bond release actions and the operational and reclamation <br />history of the mine aze accurately captured in the DMG Proposed Decision. Public and <br />landowner notification of the bond release provided by the permittee Trapper Mining, Inc. <br />(TMI); and the bond release inspection notifications provided by DMG aze also <br />documented in the Proposed Decision, DMG's inspection report for the bond release <br />inspection, and related coaespondence. OSM, the Bureau of Land Management (BLM), <br />and the State Land Board were notified of the bond release inspection, but each bureau <br />decided not to participate. DMG conducted the bond release inspection required at <br />Colcrado Rule,-Section 3.032 (2) on November 9, 2005. TMI and DMG representatives <br />participated in the bond release inspection. OSM has reviewed the resulting DMG <br />inspection report and associated correspondence. OSM has participated in previous bond <br />release inspections at TMI, including the areas in this bond release application. DMG has <br />not received any public comment regarding this SL-7 bond release application. <br />BLM concurred with the proposed decision in a teller dated May 31, 2006 (copy enclosed). <br />This Phase III bond release requests applies to 185.5 acres of cropland and 577.3 acres of <br />rangeland. Phase I and Phase II bond releases have previously been approved for these <br />acreages proposed in this Phase III release request .... , <br />. ~ ~ NAMERIC.~A~,. <br />
