TML Phase III Bond Release SL-7, vg. 2 <br />DMG's Proposed Decision documents the applicant's compliance with the Colorado <br />approved regulatory program az Rule 3.03.2, and DMG's bond release guidelines dated <br />April, 18, 1995. Bond release criteria found in the above regulatory provisions have been <br />met or exceeded by the perntittee; and successful vegetation reestablishment has been <br />demonstrated to be in compliance with the approved DMG mining permit and DMG <br />regulations. OSM has reviewed the analysis of vegetation sampling data. OSM provided <br />an e-mail to DMG dated March 9, 2006, that stated the permittee's analysis of the <br />vegetation sampling data demonstrated reclamation success and met the requirements of <br />DMG's approved mining permit, DMG regulations, and guidelines for Phase III bond <br />release. <br />OSM fords TMI has demonstrated that the mine has minimized impacts to the area's <br />hydrologiabalance. - ,_ . .. - - - - <br />Thisproposed decision will release TMI from Phase III liability on bond release blocks <br />CR 93-94, A,C, and D Pits RSC 87-95, and A, D, and H Pits RS ABcB 93-95, and the <br />reclaimed West Buzzard, East Buzzard, and Elk drainages totaling 762.8 acres. DMG <br />currently holds a reclamation bond in the amount of $18,500,000. DMG proposes to <br />release reclamation liability in the amount of $371,148. Total costs to complete all <br />remaining reclamation work at TMI aze $ 17,493,018. The remaining bond amount of <br />$18,128,854. is sufficient to cover this amount. OSM concurs witfi these amounts as <br />documented in DMG's Proposed Decision. <br />Thank you and your staff for coordinating this Federal lands bond release through the <br />DFD.
