<br />BRL complied with this request when PR-03 was submitted. <br />23. The U S. Fish & Wildlife Service, in a letter dated January 11, 1999, has x~aived the <br />depletion fee for the evaporative loss dire to the enlargement of the proposed relocated <br />pond B. However, no mention was made in Technical Revision No. 6 of additional <br />specific increases in water consumption. The Division is assuming that the increase in <br />water consrrnrption of 183 acre feet per year, listed on proposed revised page 2.Oa-57, is <br />associated with Technical Revision No. 7. The Division would like to know if there will be <br />additional rater consumption dzze to other aspects ojthis technical revision, such as <br />water spraving of coal piles and the conveyor ns well as washdoum ojthe conveyor. <br />Also, the comment letter from Chuck Roberts of the Colorado Division of Water <br />Resources, which had been forwarded to BRL, refers to the venter use plan jor Bowie No. <br />2 and asks if there will be any additions to the currently approved water consumption <br />plan dire to changes in evaporntiozz or consumption. If this is the case, and it appears <br />that it is a! lens[ for evaporation from an enlarged pond B, please contact Chzrck Roberts <br />to discuss the concerns of the Division of Water Resources. <br />BRL submitted a water depletion estimate for PR-03 in their submittal dated August 30, <br />1999. The Division has forwarded the estimate to the Office of Surface Mining (OSM) <br />with a request that OSM enter into consultation with the U.S. Fish & Wildlife Service. <br />The Division requests an update of BRL's response to the Colorado Division of Water <br />Resources letter. <br />Facilities <br />2d. In the last paragraph on proposed revised page 2.05-13, please change 'these "ro 'two " <br />in the sentence `The 2"x0"coal is stacked at the highway stockpile by these concrete <br />tubes... " <br />The Division has no further concerns. Page 2.05-13 was appropriately revised in the <br />submittal dated May 12, 1999. <br />25. On proposed revised page 2.0~-9, it is stated that the escape tube terminates at a jan <br />housing. Detail l of Drawing 98589-L002 appears to show that the fan will blow <br />horizon[ally. Since this fan is close to Old Highway /33, please confirm this fan <br />orientation and whether the exhaust fan outlet will point directly across Old Highway <br />133. <br />The Division has no further concerns. Page 2.05-14 was revised in the submittal dated <br />May 12, 1999 to state that air will not be blown south across Old Highway 133. <br />9 <br />
