<br />26. /n the permit application, on page 2.05-63, the Colorado Division of 6~ildlije requested <br />that there be overpasses or underpasses at least every quarter mile of the downhill <br />conveyor belt so that wildlife migration won f be deterred. The proposed plan, as stated <br />in the tent on proposed revised page 2.O.i-1 d and shotivn on proposed revised Map No. <br />1~-2, does not include such wildlife migratory structures. The issue of wildlife impacts <br />as they relate to the conveyor were presented in the Colorado Division oj6Vildlife's <br />(CDOW) letter, dated January 21, 1999. A copy of this letter was sent to BRL. BRL must <br />accommodate /he issues brought up by CDOW. Please discuss BRL's intentions <br />concerning this issue. <br />The Division has no further concerns. CDOW, in a letter to the Division dated September <br />9, 1999, stated that the proposed downhill conveyor configuration is adequate to allow for <br />wildlife movement and migration. Map 15-2 was revised in the original PR-03 submittal, <br />dated May 12, 1999. <br />27. For clarification, please state on pages 2.O.i-l.i through 2.O.i-17 which lengths of <br />conveyors will be totally enclosed, which lengths will be covered and which ones will be <br />zzncovered. Will all ojthe conveyor sections have underpass ? Now will the proposed <br />config:tration of the conveyor dust safeguards prevent coal from contaminating <br />undisturbed areas ? <br />The Division has no further concems at this time. BRL revised pages 2.05-15 through <br />2.05-17 in the submittal dated May 12, 1999, to show which sections of conveyor line <br />have partial covers and underpass. During field inspections, the Division will evaluate the <br />effectiveness of this system in keeping coal dust out of the undisturbed azeas adjacent to <br />the conveyor line. <br />28. Based on observations around the state dealing with com~eyors on steep slopes, the <br />Division strongly recommends that berms be placed along the conveyor corridor sides in <br />order to prevent coal from going into undisturbed areas. In addition, for erosion control, <br />the Division recommends constructing water bars across the conveyor corridor. <br />BRL chose not to respond to this comment. The Division will continue to evaluate, <br />through field inspection, the effectiveness of BRL's measures to keep coal off of the <br />undisturbed azeas. <br />Air Emissions <br />29. Please update the status of the air emissions (construction) permits. <br />The Division has no further concerns. BRL has submitted the air emissions permits <br />(construction permits) that were given initial approval from the Air Pollution Control <br />Division. The maximum annual tonnage rate has been raised to 5 million tons per yeaz. <br />10 <br />
