<br />Permit Boundary <br /> <br />30. With the proposed increase in the permit boundary and the affected area, are there any <br />occupied dwellings located wi[hin 300 feet of the new affected area that would require <br />written waivers, pursuant to Rule 2.07.6(2)(d)(v) ? <br />The Division has no further concerns. BRL responded that there are such dwellings and <br />that BRL has obtained the written waiver to conduct mining operations within 300 feet of <br />the occupied dwellings. The Division had requested Exhibits A and B of the HTitten <br />waiver, through the attorney-in-fact, fur the Hidden Valley Ranch and Cattle Company. <br />However, Exhibit A was the Special Power of Attorney document which had already <br />been submitted by BRL in its submittal dated May 12, 1999. Exhibit B was the legal <br />description of the property involved and that was supplied by BRL in its August 30, 1999 <br />submittal. <br />Bond Estimate <br />31. The Division has not finished the review oj[he reclamation bond estimate. <br />Cultural Resources <br />32. To reiterate what the Colorado Historical Society stared in its letter to the Division dated <br />December 21, 1998, ijcultural resources are uncovered during the construction project <br />that have not been identified previously, work mast temporarily cease and the resources <br />evaluated according to proper procedures. Please refer to the Colorado Historical <br />Society letter for more details. <br />The Division has no further concerns. BRL revised permit application page 2.05-90 to <br />state that, if cultural resources are discovered during construction work, BRL will <br />temporarily suspend operations and evaluate the situation according to appropriate <br />protocol. <br />ADDITIONAL QUESTIONS <br />33. BRL is proposing to relocate topsoil currently stockpiled in Piles B and C into Pile A. <br />Additionally, topsoil from the areas to be disturbed for the downhill conveyor project will <br />be stored in Pile A as discussed on revised page 2.05-3.i. BRL states that approximately <br />20,100 cubic yards of topsoil will be salvaged from the disturbance associated with the <br />downhill conveyor project. Topsoil salvage from construction of Pond B is not <br />specifically addressed. Has it been considered as part of the downhill conveyor project, <br />or does it need it to be addressed? <br />
