A copy of the agreement is enclosed far reference. <br />4. According to the Slurry Wall Alignment and Details Map, the slurry wall contains approximately 94 <br />acres of the gravel pit and lies within the 100-year flood plain. It appears that there is a strong <br />hydrologic connection between the Cache La Poudre River and the surrounding flood plain (riparian <br />& wetlands). The applicant will need to explain the normal and essential hydrologic functions of <br />recharge and discharge for this alluvial-ground water system and what short-term or lone-term <br />impacts might be expected with the presence of the slurry wall. The applicant will also need to <br />characterize and discuss any possible impacts to adjacent wells, homes and other man-made <br />structures. If appropriate, 'the applicant will need to provide plans to mitigate such impacts. <br />5. The Division previously sent the operator a copy of the letter from Clem Mcnaney received on <br />February 25, 2000. In summary, the concems raised in the letter aze impacts to the Mcnaney <br />property due to the obstruction of the floodway and flooding of the property due to construction of <br />the slurry wall. Please address the concems noted in the letter. <br />6. In addition to the Mcnaney letter, the Division received a letter from the West Greeley Soil <br />Conservation District regarding the permit amendment. <br />Under the Construction ;Material Rules and Regulations, if objections or concems of a 112 <br />Application or Amendment are received, the Division is required to hold three public meetings. The <br />three meetings are described below. <br />• Informal Conference (Rule 1.4.6) The purpose of the informal conference is to identify all <br />parties to the proceedings and formal Board Heazings, determine what issues have been resolved <br />(if any), and if there aze additional issues, identify the issues that the Board, by statute, have <br />jurisdiction to address, and explain the hearing process. This meeting will be scheduled after the <br />public comment period. <br />• Pre-hearing Conference (Rule 2.7) The Pre-Hearing Conference will be presided over by the <br />Pre-Hearing Conference Officer. The Pre-hearing Conference Officer is appointed by the Mined <br />Land Reclamation Board. The purpose of the Pre-Hearing Conference is to draft a hearing order <br />that lists issues the full Board should consider, lists the witnesses and evidence to be presented <br />by parties, lists the parties that will participate, determine the amount of time afforded each <br />party, and to resolve .my other issues that the Pre-hearing Conference Officer determines is <br />appropriate. <br />• Formal Board Hearing (Rule 2.8) The Board will conduct the Hearing according to the <br />provisions of the adopted hearing order, the Administrative Procedures Act, Section 24-4-105, <br />Colorado Revised Statutes (C.R.S.), and the Colorado Code of Regulations, 2 CCR 407-4, <br />Section 2.8. The Formal Public Hearing will be held in Room 318 of 1313 Sherman Street, <br />Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter as the matter can be considered. <br />The Division will contact the applicant,. objectors and other interested persons regarding the meeting <br />dates and time. <br />2 <br />
