The Division of Minerals and Geology <br />(Division) is required to make an approval or denial decision no later than April 20, 2000, therefore, <br />your response to the following; adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated <br />in the local newspaper artd all owners of record of surface lands, and easement holders that are <br />within 200 feet of the bolmdary of the affected land. Proof of notice may be return receipts of a <br />Certified Mailing or by proof of personal service. <br />2. The applicant provided a map of the slurry wall alignment and construction details at the La Poudre <br />Sand and Gravel site. The following items need to be included on the map; <br />• The map must be signed by a registered land surveyor, professional engineer, or other qualified <br />person (Rule 6.2.1(2)(b)). <br />• Please indicate the location of the Mcnaney property and associated permanent man made <br />structures (Rule 6.4.3(x)). <br />• Please show the owner's name, type of structures, and location of all permanent or man-made <br />structures contained on the azea of affected land and within 200 feet of the affected land (Rule <br />6.4.3(8). <br />3. Hall-Irwin proposes to change the post mining land use from open space, conservation and <br />recreation to developed water resources. The applicant will need to specify in writing the specific <br />permit azea that will be changed to developed water resources and the areas that will remain as open <br />space, conservation and recreation. In addition, please clarify how this change in land use will <br />comply with the "Ratification of Deed of Easement for Hunting, Fishing and Other Recreation" <br />signed by Hall-Irwin Construction Co. on June 8, 1994.
