Automatic Coverage: If the applicant does not receive a request for additional information or a notification of <br />denial from the Division dated within thirty days of the receipt of the application by the Division, authorization <br />to dischazge in accordance with the conditions of this permit shall be deemed granted. <br />c. Individual Permit Required: If, afrer evaluation of the application (or additional information, such as the <br />SWMP), it is found that this general permit is not applicable to the operation, then the application will be <br />processed as one for an individual permit. The applicant will be notified of the Division's decision [o deny <br />certification under this general permit. For an individual permit, additional information may be requested, and <br />180 days will be required to process the application and issue the permit. Temporary coverage under this <br />general permit may be allowed until the individual permit goes into effect. <br />d. General vs. Individual Permit Coverage: Any owner or operazor authorized by this permit may request to be <br />excluded from the coverage of this permit by applying for as individual CDPS permit. The owner or operator <br />shall submit an individual application to the Division, with reasons supporting the request. <br />6. Permit Certifications. Applicable Sections: <br />The individual certification prepazed for each applicant will indicate whether Part I.B of the permit which must be <br />followed by that applicant. Pan I.C must be followed by all permittees unless exempted as outlined in Section III.C of <br />the Rationale. (In the absence of such indication from the Division, the permittee will be responsible for deurmining <br />and [hen complying with the applicable sections in Part I.) In addition, all cermittees will be required to comply <br />with Part I, subparts A, D, E and F, and all of Part II of the permit. <br />• 7. Permk Expiration Date <br />Authorization to dischazge under this grneral permit shall commence on October 1, 1997, and shall expire on <br />September 30, 2002. The Division must evaluate and reissue this general permit once every five years, and must also <br />recertify the applicant's authority to discharge under the general permit az such time. Therefore, any permittee desiring <br />continued coverage under the general permit must reapply by Mazch 31, 2002. The Division will determine if the <br />applicant may continue to operate under the terms of the general permit. <br />An individual permit will be required for any facility not reauthorized to dischazge under the reissued general permit. <br />For facilities wishing to terminate authorization under the new permit, provisions of Pan II.B.S.d will be applicable. <br />8. Inactivation of Certification <br />The permittee may request inactivatiomof their certification under this permit, once the site has been fully released <br />from their reclamation bond requiremenss by the Colorado Division of Minerals and Geology (CDMG). See Part <br />II.B.S.d of the permit. <br />B. EFFLUENT LIMITATIONS AND CONDITIONS -PROCESS WATER DISCHARGE <br />(This section (I.B) only applies to facilities with a dischazge of process water.) <br />General Limitations <br />a. There shall be no dischazge of sanitary waste wazers from toilets or related facilities. <br />b. There shall be no discharge of floating solids or visible foam. <br />c. No chemicals aze to be added to dte dischazge unless permission for the use of a specific chemical is granted by <br />the permit issuing authority. in granting [he use of such chemicals, additional limitations and monitoring <br />requirements may be imposed. <br />
