' The 1973 geological study and test hole information included in the originally approved permit is <br />retained as submitted under Exhibit D -Mine Plan of the 2003 Amendment. This information <br />I best shows the natural and non-disturbed range of goundwater at four to nine feet below the test <br />hole surface. The aquifer that has been dewatered is a surfica] aquifer associated with the Poudre <br />River Valley, and is not a bedrock aquifer. Pierre Shale underlies the unconsolidated gravels. <br />22. In accordance with Rule 6.4.7(2)(c), please submit a brief statement or plan showing how <br />water from de-watering operations or runoff from disturbed areas, piled material and operating <br />surfaces will be managed to protect against pollution of either surface or groundwater (and, wfiere <br />applicable, control pollution in a manner that is consistent with water quality discharge permits), <br />both during and after the operation. <br />i Effects of materials pulled from in-situ location, processed and stockpiled on site drain internally. <br />The outfall for discharge is rip-rapped. No negative effects aze expected nor have they been <br />observed over the previous 20 years of operations. The site operates under an approved Colorado <br />Department of Health Storm-water Management Plan. <br />23. In accordance with Rule 6.4.7(3), please provide an estimate of the project water requirements <br />including flow rates and annual volumes for the development, mining, and reclamation phases of <br />the project. <br />This information was detailed in the application for a Substitute Supply Plan to the Colorado <br />Office of the State Engineer, and included in total under Exhibit G -Water Information of the <br />2003 Amendment submittal for the Division's review. <br />24. In accordance with Rule 6.4.7(4), please indicate the projected amount from each of the <br />sources of water to supply the project water requirements for the mining operation and <br />reclamation. <br />As previously stated, this information was detailed in the application for a Substitute Supply Plan <br />to the Colorado Office of the State Engineer, and included in total under Exhibit G -Water <br />Information of the 2003 Amendment submittal for the Division's review. Additionally, pages 4-5 <br />of Exhibit L -Water, details how water will be accounted for via the extraction and reclamation <br />of the property over time, over the areas of extraction and reclamation. <br />25. Please clarify whether the Greeley #3 Ditch is an active ditch, ie: flowing water during part or <br />all of the year; and whether the ditch will or will not be adversely affected by VCI's de-watering <br />and dry mining activities. <br />Greeley #3 is an ephemeral ditch. No negative effects on the ditch have been observed in the <br />previous 20 years of operations. No water intrusion from the ditch has occurred, except that the <br />ditch will convey waters when the County bridge at Fern Street obstructs flood waters of the <br />Poudre River. Extraction activity is completed within the proximity of the ditch, which is <br />protected from operations by established access roads and reclaimed slopes, which provide a well <br />compacted barrier to the ditch from the resulting pit basins. <br />26. The applicant indicates that they have obtained a Substitute Supply Plan (SSP) from the <br />Office of the State Engineer (OSE) in July, 2003 to cover both existing and planned exposed <br />Varna Companies, Inc. M1978-056 Durham Sand & Gravel Pit - 2003 Amendment - 11 <br />Monday 26 Apri12004 reply to correspondence from the Colorado Division of <br />Minerals and Geology of 6 January 2004. <br />
