However, attached is a copy of review comments from the Office of the State <br />Engineer (OSE) which indicates that the existing substitute water supply plan for the Durham <br />Sand and Gravel Pit expired on October 31, 2003 and that VCI will need to obtain a either a <br />gravel pit or other type of well permit for the proposed activities. Further, included in Exhibit G - <br />Water Information is a copy of July 10, 2003 correspondence from William H. Fronczak of OSE <br />to Cheryl Signs that indicates the following: a) the existing SSP is conditionally approved until <br />October 31, 2003 and that permanent approval of the plan is necessary, b) a well permit must <br />also be obtained in conjunction with the approved SSP, c) VCI application for a SSP assumes the <br />condition of a lined pond, rather than a groundwater fed lake. Please respond. <br />The SSP as it is constructed was simply misinterpreted by the Division and does apply to a <br />groundwater fed lake. Accordingly, condition one at the bottom of page two of the SSP, as <br />included under Exhibit G of the Amendment, has been met, and per two at the bottom of page <br />two of the SSP, the SSP is approved to 31 July 2005. <br />The well permit application has been submitted to the OSE and is presently under review. Given <br />the benign effect on adjacent wells from discharge at the mine, as reflected in the evaluation by <br />CGRS of 5 Apri12004, and considering that the well permit can be issued since the SSP is <br />approved, we anticipate that a well permit will be issued. The Division will be kept informed of <br />any developments pertaining to either the SSP or the well permit. <br />27. The applicant has petitioned the Division to agree as part of the approval of this Amendment <br />application (AM-I) that any subsequent and necessary revisions to Permit M- 78-056 pertaining <br />to the Floodway or Floodplain be allowed as a sepazate technical revision. The Division requests <br />that all currently available and appropriate Floodway and Floodplain information for the affected <br />land and surrounding area be provided and evaluated to the extent that the applicant can clearly <br />demonstrate that the proposed mining and reclamation plan will comply with the requirements of <br />Rule 3.1.6, ie: 1) minimize disturbances to the prevailing hydrologic balance of the affected land <br />and of the surrounding area, 2) result in a flood control berm /north shoreline that will not <br />damage adjoining property or conflict with water pollution laws, rules or regulations of the <br />federal government, the state of Colorado or with any local government pollution ordinances, and <br />3) result in a flood control berm /north shoreline that is stabilized and protected so as to <br />effectively control erosion. <br />In response, the Division requests that VCI provide any relevant and available Floodway <br />designations for Jhe reach of the Cache La Poudre River in and near the Durham Pit. Such <br />Floodway designation(s) whether current or old should include ftoodway boundaries, base flood <br />elevations, date(s) of designation, and the authorizing federal and/or state organizations(s). The <br />Division also requests that VCI provide any available maps and/or photographs showing the <br />extent, elevation, and condition ofthe flood control boundary along the south bank of the Cache <br />La Poudre River at the time of submittal for the original permit application, ie: February 28, <br />1978. Please provide. <br />Chris Pauley, civil engineer for Anderson Consulting, has requested additional time for his <br />evaluation due to continued difficu]ty in obtaining established information from FEMA and the <br />Army Corps of Engineers (refer to Chris Pauley's correspondence of 30 March 2004 requesting <br />additional time to 28 May 2004 for completion of his initial evaluation. The information <br />requested by the Division will be provided to the Division at the time of submittal of the <br />completed report.
