3.3 The Contractor will be responsible for the operation and maintenance of <br />the dewatering and bypass system and shall be liable for damage to the <br />subgrade, foundation or structures, and enforcement actions by state or <br />federal agencies resulting from proper or improper operation of the <br />dewatering and temporary bypass systems including negligence; and shall <br />correct any such damage at his own expense, regardless of previous <br />review by the Engineer. Contractor's responsibilities and obligation shall <br />include the areas where construction activities will affect the normal water <br />handling systems at the mill. <br />3.4 All diversions of fresh water into the process water system from areas <br />currently collected by the fresh water interceptor systems must be <br />approved by the Owner. <br />3.5 After having served their purpose, all temporary cofferdams or other <br />protective works shall be removed or leveled and the site restored to either <br />its original condition, or that condition required by performance of the <br />Work. <br />4 DEWATERING AND PROCESS WATER BYPASSES <br />4.1 All water removed from excavations shall be discharged into the Process <br />Water System, unless the discharge of this water into the Fresh Water <br />system has been approved by the Owner. <br />4.2 Any temporary pumping equipment used for dewatering or for bypassing <br />process water flows shall be designed and operated such that the flow will <br />be contained or otherwise re-diverted to the Process Water Containment <br />System during power failures or other upset conditions. Any such <br />emergency routing of the flows will be contained by liners or other barriers <br />to prevent infiltration into soils outside the containment area. <br />5 STORM WATER MANAGEMENT <br />The Contractor shall employ appropriate storm water control measures consistent <br />with the requirements of the Henderson Mill Storm Water Management Plan. The <br />Contractor responsibilities shall include furnishing, installing, and maintaining <br />accepted storm water best management practices designated for controlling <br />sediment discharges into waters that are not within the process water <br />containment area. Storm water control measures shall include, but not be limited <br />to, the following: <br />5.1 Storm water shall not be allowed to discharge from the construction areas <br />without being treated by one or more the following: <br />SPEC G -ENVIRONMENTAL CONTROLS <br />PAGE 2 <br />
