The estate has not been in a position <br /> 8 to release funds for the preparation of a massive application <br /> 9 and there was controversy at the time about that; but we <br /> 10 are agressively working with Chuck Webster and Mr. Cosgriff, <br /> 11 in order to get that together for purposes of this hearing <br /> 12 and for purooses of the civil penalty and everything else. <br />. 13 Our interests are identical for the estate and <br /> 14 for Idr. Webster. So we are here to work with Mark Loye and <br /> 15 with the staff and with the Board and we are not any adversary <br /> 16 sitting for these purposes right here. <br /> 17 MR. COSGRIFF: Mr. Chairman, I would address <br /> 18 specifically the recommendations of the staff as to imposition <br /> 19 of penalty. I gather the recommendations are twofold: <br /> 20 (1) the expansion of the Cease and Desist Order to he a <br /> 21 total Cease and Desist Order, no longer removal of stockpile; <br /> 22 and (2) to be as an assessment of a fine, a significant <br /> 23 fine, a portion of which would be deferred or extending <br /> 24 $500 a day for--how many days was it? <br /> <br /> 25 MR.
