It is in the process of moving <br />ahead, not withstanding who owns the particular pit. L•]e have <br />assured Mr. Loye that the permit application will be filed <br />November 1 and that we think that deadline is reasonable and <br />can be met. <br />Again, in pointing out any assessment of <br />penalties--we realize this is discretionary with the Board-- <br />but the reason for the delay--we think it's hard to say, <br />"justified",but there were certainly facts that would, I <br />think, dictate no action. We were just not in a position to <br />do that. <br />Here also representing the estate is John <br />Watson, who might just enter a comment as to further evidence. <br />h1R.
