Minutes, August 23-24, 1989 <br />PAGE 13 <br />Staff presented ATTACHMENT 0 - an August 23, 1989, letter from the <br />operator in response o e statements of opposition. Staff <br />recommended that a Public Hearing not be scheduled, on the basis that <br />there were no issues of objection within the Board's jurisdiction which <br />had not been addressed to its satisfaction by the operator. <br />Ms. Sally Hardy referenced an August 12, 1989, citizen's letter and <br />addressed the Board, regarding the issue of a Formal Public Hearing. <br />It was MOPED that the Board hold an Informal Public Hearing today, <br />regarding ~Tiis matter. SECONDED AND PASSED UNANIMOUSLY (Danielson, <br />O'Connor, Donald, Kraeger-Rovey and Cooley). <br />Staff presented information that this would be a 10-phase open pit <br />rhyolite quarry. The applicant would disturb 660 of the 1,606 <br />permitted acres, over the life of the mine. The plan calls for phased <br />mining, with concurrent reclamation, so the maximum area to be <br />disturbed at any one time would be 79 acres. A map of the area was <br />used for reference, as the proposed mining and reclamation plans were <br />discussed. The area will be revegetated by native species and returned <br />to rangeland use. Staff related that all the technical issues in <br />connection with the application, i.e., those within the MLRB's <br />jurisdiction, have been resolved. <br />Staff Recommendation: 1) approve the application, with the stipulation <br />that sedimentation ponds be designed to retain a 10-year storm event, <br />and 2) submit a E295,850 bond. <br />Staff related that the applicant was in agreement with the <br />recommendation. <br />Mr. Gary Tuttle and Mr. Mike Applegate, consultants for the applicant, <br />presented two samples of rhyolite to the Board for review and discussed <br />this mineral, including its mining and usage. A drawing of a map of <br />the area was referenced, and the reclamation, final-use and drainage <br />plans were discussed. <br />The following citizens addressed the Board, regarding this issue: <br />1. Jeanette Evans, the Planning Director for Castle Rock; <br />2. Mr. William Windier, presented ATTACHMENT P - an April 13, 1986, <br />memo regarding a meeting with M a and the applicant. He also <br />presented ATTACHMENT Q - an August 24, 1989, letter of concern to <br />MLRD from imsfi eT~ an3-members of the Associated Homeowners of Castle <br />Rock; <br />3. Mr. Henry Into and Mrs. Frances Into; <br />4. Mr. Donald Moore, with the Douglas County Planning Commission; <br />5. Ms. Janet Smith; <br />6. Ms. Sally Hardy; <br />7. Mrs. Beatrice Jane Jones; <br />8. Mr. Herbert I. Jones, who spoke also in behalf of Doctor Jobb; <br />9. Ms. Kathy Hall and <br />10. Ms. Lora Parks Diamon. <br />
