Staff presented ATTACHMENT 0 - an August 23, 1989, letter from the
operator in response o e statements of opposition. Staff
recommended that a Public Hearing not be scheduled, on the basis that
there were no issues of objection within the Board's jurisdiction which
had not been addressed to its satisfaction by the operator.
Ms. Sally Hardy referenced an August 12, 1989, citizen's letter and
addressed the Board, regarding the issue of a Formal Public Hearing.
It was MOPED that the Board hold an Informal Public Hearing today,
regarding ~Tiis matter. SECONDED AND PASSED UNANIMOUSLY (Danielson,
O'Connor, Donald, Kraeger-Rovey and Cooley).
Staff presented information that this would be a 10-phase open pit
rhyolite quarry. The applicant would disturb 660 of the 1,606
permitted acres, over the life of the mine. The plan calls for phased
mining, with concurrent reclamation, so the maximum area to be
disturbed at any one time would be 79 acres. A map of the area was
used for reference, as the proposed mining and reclamation plans were
discussed. The area will be revegetated by native species and returned
to rangeland use. Staff related that all the technical issues in
connection with the application, i.e., those within the MLRB's
jurisdiction, have been resolved.
Staff Recommendation: 1) approve the application, with the stipulation
that sedimentation ponds be designed to retain a 10-year storm event,
and 2) submit a E295,850 bond.
Staff related that the applicant was in agreement with the
recommendation.
Mr. Gary Tuttle and Mr. Mike Applegate, consultants for the applicant,
presented two samples of rhyolite to the Board for review and discussed
this mineral, including its mining and usage. A drawing of a map of
the area was referenced, and the reclamation, final-use and drainage
plans were discussed.

1. Jeanette Evans, the Planning Director for Castle Rock;
2. Mr. William Windier, presented ATTACHMENT P - an April 13, 1986,
memo regarding a meeting with M a and the applicant. He also
presented ATTACHMENT Q - an August 24, 1989, letter of concern to
MLRD from imsfi eT~ an3-members of the Associated Homeowners of Castle
Rock;
3. Mr. Henry Into and Mrs. Frances Into;
4. Mr. Donald Moore, with the Douglas County Planning Commission;
5. Ms. Janet Smith;
6. Ms. Sally Hardy;
7. Mrs. Beatrice Jane Jones;
8. Mr. Herbert I. Jones, who spoke also in behalf of Doctor Jobb;
9. Ms. Kathy Hall and
10. Ms. Lora Parks Diamon.
