Minutes, August 23-24, 1989 <br />PAGE 12 <br />It was MOPED that the Board levy a Civil Penalty for 2 days of <br />disturbance, at 5100 per day fora total of E200, at the Upper Mary <br />McKinney Mine. SECONDED AND PASSED 4 for (Danielson, O'Connor, Donald <br />and Entz); 1 against (Cooley); 1 abstention (Kraeger-Rovey). <br />It was MOPED that the Board assess a Civil Penalty for X100 per day for <br />6 days i~or a total of E600 for the Hull City/Sacramento site. SECONDED <br />AND PASSED 5 for (Danielson, O'Connor, Donald, Entz and Cooley); 1 <br />abstention (Kraeger-Rovey). <br />16. FORMAL PUBLIC HEARING <br />R GOLD MINING COMPANY File No. M-89-061 <br />5932 McIntyre Street <br />Golden, CO 80403 <br />All individuals wishing to give testimony were sworn. <br />SE 1/4, SE 1/4, Sec. 20, T15S, R69W, 6th P.M., Teller County, 9.9 <br />acres. Consideration of possible notice of violation, cease and desist <br />order, corrective actions and civil penalties for mining without a <br />permit. <br />This matter concerns the Hull City/Sacramento mine site. The Board <br />considered this Item along with Item 1115 and, in determining that a <br />violation had occurred, levied a Civil Penalty in the amount of E600 <br />far 6 days of disturbance at a ;100 per day. <br />It was MOVED that the Board stand in recess. For the benefit of concerned <br />citizens, interested parties, etc., the Board clarified jurisdictional <br />issues. <br />At the Board's request, <br />statement of opposition <br />Staff related that upon <br />that are not within the <br />dust, etc..
