Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application for a permit revision. The application was <br />submitted by National Kinq Coal, for the Kinq Coal Mine. This approval <br />decision is based on a finding that the proposed operation will comply all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101, et sea., and the regulations promulgated thereunder. If no request <br />for a formal hearing is made within thirty (30) days of the first publication <br />of the issuance of this proposed decision, then this decision becomes final. <br />The permit application, all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. <br />List of Stipulations resulting from this Permit Revision application: <br />Stipulation No. O8: <br />WITHIN 60 DAYS OF APPROVAL OF PERMIT REVISION 03, NATIONAL KING COAL WILL <br />SUBMIT A PLAN IN THE FORM OF A TECHNICAL REVISION TO THE PERMIT THAT <br />SHALL INCLUDE CHANGES TO THE PRIMARY AND EMERGENCY SPILLWAYS OF EACH POND <br />AND INCORPORATE ROUTING CHANGES TO THE EAST DRAINAGE DITCH. THE PLAN <br />SHALL COMPLY WITH THE APPLICABLE PORTIONS OF RULES 4.05.4, 4.05.5, <br />4.05.6, 4.05.7, AND 4.05.9. <br />Stipulation No. 09: <br />WITHIN 60 DAYS OF APPROVAL OF PERMIT REUISION 03, NATIONAL KING COAL WILL <br />SUBMIT IN THE FORM OF A MINOR REVISION TO THE PERMIT A FINAL RECLAMATION <br />PHASE SEED MIXTURE WHICH INCLUDES BOTH WARM AND COOL SEASON GRASSES. THE <br />MIXTURE SHALL COMPLY WITH THE APPLICABLE PORTIONS OF RULES 4.15.2 AND <br />4.15.8. <br />-2- <br />
