information which does include OSM as a beneficiary.
The current bond amount of $393,000.00 is secured by
irrevocable letter of credit number 12632 which was issued by
the Central Bank of Grand Junction, Colorado. The obligation
for the letter is held by Central Bank National Association of
Denver, Colorado. This information was provided by DMG as a
result of this inspection. The bond amount of $393,000.00 is
the same amount of bond which existed prior to the release of
the loadout which occurred some time early in 1994.
Therefore, one must assume that although liability for the
loadout has been released, the bond amount was not reduced.
If this information is not correct, DMG must supply the
current bonding documents to OSM.
Another issue concerning the bond is the discharge which is
occurring from the #1 mine portal area. It is assumed at this
time that the discharge will be perpetual and will require
treatment due to the heavy concentrations of iron contained in
the water being discharged. If this is indeed the case,
further reduction of the bond will not be allowed. It is also
recommended that DMG review the bond amount based on the
treatment of the discharge and require the permittee to post
any additional bond which may be needed or in lieu of this
have the bond monies placed in an interest bearing account so
that it will generate enough income to maintain the treatment
and monitoring of the discharge should the company default on
their responsibility. DMG should work with OSM in resolving
this issue.
Discharge Permit: The discharge permit CO-0029599, issued by
the Colorado Department of Health, became effective on
04/01/94 and expires 01/31/99. There are currently 5
discharge points allowed by the permit. Discharges were
reported at outfalls 001 and 007 during the first quarter of
1994 and at outfall 007 during the second quarter of 1994.
All discharges were within the limits stated in the permit.
Water Monitoring: Refuse wells D-lA and D-2A are required to
be monitored on a quarterly basis. North Thompson Creek is
required to be monitored on a bi-annual basis. All monitoring
information was contained in the annual report which is
submitted to DMG.
Air Quality Monitoring: The air emissions permit was cancelled
on 02/16/90 and no further monitoring is required.
Subsidence Monitoring: The information in the mine plan was
4
