98 <br />1 "An operator issued any notice of <br />2 violation or any person having an interest which is <br />3 or may be adversely affected." That to me says <br />4 there are two classes of people that this <br />5 addresses; operators who have been issued a notice <br />6 of violation and any other person whose interest <br />7 may be adversely affected by the notice of <br />8 violation, and it does go on to say, any <br />9 modification, vacation, or termination. <br />10 But again that's two classes of people, <br />11 and one of those classes, by my reading of that <br />12 statute, is an operator who's been issued a notice <br />13 of violation, and then it goes on to say, "may <br />14 request review thereof by the board within 90 days <br />15 after the issuance of a notice or within 90 days <br />16 after the vacation, modification, or termination of <br />17 the notice." <br />18 So there are two instances that the <br />19 statute gives rise to an operator who's been issued <br />20 a notice to request a hearing on the notice. One, <br />21 they can request a hearing on the notice; two, they <br />22 can request a hearing in this case on the vacation <br />23 of a notice. <br />24 The adversely affected nature of the <br />25 party, as far as I can see from the statute, <br />
