<br />PAGE 3 <br />i <br />certificate of insurance. The notification language for cancellation <br />will be changed to remove "endeavor to". <br />Water monitoring records were current. It was noted that the total <br />iron was exceeded at discharge point OOlA during the second quarter <br />of 1991. The records showed the 30 day average at 17 and the daily <br />maximum at 19. The allowed is 3.5 and 7.0 respectively. Previous <br />water monitoring did not show elevated iron concentrations. Since <br />this occurred during the latest reporting period it was not possible <br />to determine a pattern. MLRD and the company should monitor the <br />situation closely and take the appropriate action if iron levels do <br />not decrease. <br />It was found that the approved air emissions permit was not being <br />complied with. The conveyor belts on the Roadside mine are required <br />to have total or partial cover. They had no cover in most areas. <br />MLRD will not enforce the air emissions permit but will report it to <br />the Department of Health. <br />Pond inspection were current. <br />The haul roads which were pre-existing have been certified to be in <br />compliance with rule 4.03.1. <br />All ponds have been certified to have been constructed in accordance <br />with the approved plan. <br />All ponds were checked on the mine and the following was noted: <br />Ponds 4, 5 and 6 have combination spillways which are no longer <br />allowed under the Colorado program. MLRD had notified all coal <br />operators that these had to be replaced by September 1, 1991. In a <br />telephone conversation with Larry Routten on 9-17-91 he informed me <br />that MLRD will issue a notice of violation to Powderhorn Coal <br />requiring the ponds to be brought into compliance with rule <br />4.05.6(3)(e). <br />Pond ll2 has had its storage capacity enlarged by an adjacent rock <br />borrow area. This is an incised pond and this should not effect its <br />integrity. <br />Pond It7 appears to have had water entering through the emergency <br />spillway This was due to a blockage in the spillway channel which <br />will be cleaned. <br />No problems noted with the remaining ponds. <br />Subsidence above the Roadside mine was looked at with no substantial <br />subsidence observed. The area is being monitored. <br />Perimeter markers were not present around a substantial part of the <br />surface disturbance. FII.RD will issue notice of violation IIC-91-020 <br />for signs and markers. The violation will include the perimeter <br />markers and rile topsoil signs. <br />MLRD will also issue notice of violation It C-91-019 for failure to <br />include electrical substations in the approved small area <br />exemptions. <br />
