<br />PAGE 4 <br />1^ <br />The north decline area has not been reclaimed. No mining has been <br />done in the area in approximately 4 years and the mine portal has <br />been sealed for 1 year. The seal was placed approximatley 40 feet <br />inside the portal. The portal entrance currently has standing water <br />which according to Powderhorn is rising at the rate of 3 feet per <br />month. The portal entrance has not been blocked from entry but the <br />company has agreed to block it. There was some discussion of <br />reclaiming the area this fall, however that is not firm. The MRP has <br />a reclamation time table which according to MLRD will start at the <br />end of the life of the mine. The life of the mine being after all <br />operations stop. The reclamation schedule indicates that regrading <br />of the north decline will be completed by the end of the third <br />quarter the first year after all operations cease. The MRP does <br />state "Areas such as the north decline and refuse piles may be <br />started sooner than that." OSM does not believe the area is being <br />reclaimed in a contemporaneous manner and for that reason Ten-Day <br />Notice 11 91-02-352-001 is being issued. <br />MSEIR: Those blocks in item 25 marked with a "2" are explained above, <br />those marked with a "3" are not applicable to the operations and <br />those left blank were not checked <br />
