<br />FINDiN(~S <br />1. The area of major impact encompasses an area of approximately <br />L4 lull sections of land upon which there are located 17 residential units. <br />The area is low density and has not been subdivided. !t has approximately <br />1.4 square mile per residential unit. <br />'L. 't'ruck traffic to and from the proposed asphalt plant would not <br />appear to unduly damage proposed roads located in the area of impact. To insure <br />minimal impact to existing County roads certain conditions will be imposed <br />which will be hereinafter set forth. <br />:3. 't'he rehabilitation plan proposed by the applicant and approved <br />by the Mined Land Reclamation Board appears to be satisfactory to preserve <br />the aesthetic and rural nature surrounding the proposed site. <br />4. Air Emission Quality Control as established by the State of <br />Colorado and certain Federal agencies which permit the emissions of smoke, <br />odors, noise and dust are well within the limits established by the Colorado <br />Department of Health and other regulatory agencies. These would not appear to <br />constitute any hazard or injurious effect to the health, welfare, or safety of <br />the inhabitants of Elbert County. <br />THE COMMISSIONERS, THERENURE, ADOY1"1HE rULIlXJ1NC ORDER AND <br />RESOL[Pi'ION: <br />ORDER <br />1. Permission is hereby granted to the applicant, Terra Construction <br />Company, to operate an asphaltic hot mix plant and/or a concrete hatching plant <br />on a tract of land located in Section 1ti, 't'ownship 6 South, Range 64 West of <br />the bth Y.M., County of Elbert, State of Colorado, canprisingG3.B/ acres in <br />the northwest quarter, northeast quarter of Sect ion GB, subject to the follow- <br />ing conditions: <br />(a) That the applicant shall, in accordance with its proposed plan <br />and agreement, maintain, as required, roads 17-11, Road 'Ly, Road L1, Road 1/4, <br />Road li and all other public roads which service said property within a three- <br />mile radius of the proposed plant site, if such roads are utilized for hauling. <br />The continued maintenance provision should be effective only so long <br />as said roads are a gravel surface. In the event the impacted roads are <br />subsequently paved then applicable agreement for continued maintenance would <br />terminate. <br />-"L- <br />
