~.
(b) That the applicant has offered to construct an extension of
Road 174 to Road 13 to minimize traffic flow on Roads 17-21 and also has agreed
to extend Road 174 to Road 29 to minimize traffic flora into the developed areas
to the west of the proposed site. The applicant shall also make those improve-
ments which it has agreed to make to minimize traffic hazards on routes utilized
to haul to and from the proposed site, particularly those which may exist in
connection with Road 17-21. The proposed improvements potentially involve the
removal of cattle guards on certain of the impacted roads as need may occur or
be required, and further the fencing of road right-of-way in areas where removal
of cattle guards are indicated or required. In the event road 17-21 does not
require removal of existing cattle guards then no fencing of adjoining right-of-
way would be needed.
(c) All provisions for road improvements, construction. and main-
tenance of existing county roads as herein required shall be performed pursuant
to the rules and regulations of Elbert County. The impacted roads to be done
shall be performed following a joint inspection of the improved roads by the
County Commissioner of the appropriate district in which that road is located,
or by his designee, and contract maintenance as herein required be performed
under his direction and supervision.
(d) Conditions concerning pollution, emissions and other operational
aspects of the plant are controlled through other agencies of the state and are
not subject to imposition of conditions by the County Commissioners of Elbert
County. From the evidence adduced at the hearing, all standards imposed by the
respective state and Federal government agencies involving the operation of the
plant, have been applied for and permits obtained or are in the process of being
obtained, and therefore, are beyond the jurisdiction of the Board of County
Commissioners.
(e) The applicant shall also obtain all easements required to
effectuate the construction and extensions of the existing roads to accomplish
the flow pattern indicated by it which would minimize heavy truck traffic as
much as possible upon Roads 17-21 and heavily developed residential areas to
the west of the proposed plant site. The provisions of that certain order
approved by the Board of County Coirnnissioners on March 19, 1982, is incorporated
as if herein fully set forth and is made a part hereof.
(f) The Special Use permitted herein shall only be effective so long
as the applicant or its successors operate the asphalt batch plant and/or concrete
batch plant in accordance with the aforesaid conditions.
The conditions set forth herein and in the order of March 19, 1982,
shall be binding upon the applicant or its successors in interest, and its
sublesses or its grantees.
The above and foregoing ORDER where inconsistent or different from
the provision of the Commissioner's ORDER entered on March 19, 1982, shall
supersede the provisions of said ORDER and shall be controlling.
ORDERED AND APPROVED by the Board of County Con¢nissioners of Elbert
County, Colorado, this day of ~/j/J,~~ 1983, to be
effective as of said date.
BOARD OF CO COMMI STONERS
enn A. art, airman
