~. <br />(b) That the applicant has offered to construct an extension of <br />Road 174 to Road 13 to minimize traffic flow on Roads 17-21 and also has agreed <br />to extend Road 174 to Road 29 to minimize traffic flora into the developed areas <br />to the west of the proposed site. The applicant shall also make those improve- <br />ments which it has agreed to make to minimize traffic hazards on routes utilized <br />to haul to and from the proposed site, particularly those which may exist in <br />connection with Road 17-21. The proposed improvements potentially involve the <br />removal of cattle guards on certain of the impacted roads as need may occur or <br />be required, and further the fencing of road right-of-way in areas where removal <br />of cattle guards are indicated or required. In the event road 17-21 does not <br />require removal of existing cattle guards then no fencing of adjoining right-of- <br />way would be needed. <br />(c) All provisions for road improvements, construction. and main- <br />tenance of existing county roads as herein required shall be performed pursuant <br />to the rules and regulations of Elbert County. The impacted roads to be done <br />shall be performed following a joint inspection of the improved roads by the <br />County Commissioner of the appropriate district in which that road is located, <br />or by his designee, and contract maintenance as herein required be performed <br />under his direction and supervision. <br />(d) Conditions concerning pollution, emissions and other operational <br />aspects of the plant are controlled through other agencies of the state and are <br />not subject to imposition of conditions by the County Commissioners of Elbert <br />County. From the evidence adduced at the hearing, all standards imposed by the <br />respective state and Federal government agencies involving the operation of the <br />plant, have been applied for and permits obtained or are in the process of being <br />obtained, and therefore, are beyond the jurisdiction of the Board of County <br />Commissioners. <br />(e) The applicant shall also obtain all easements required to <br />effectuate the construction and extensions of the existing roads to accomplish <br />the flow pattern indicated by it which would minimize heavy truck traffic as <br />much as possible upon Roads 17-21 and heavily developed residential areas to <br />the west of the proposed plant site. The provisions of that certain order <br />approved by the Board of County Coirnnissioners on March 19, 1982, is incorporated <br />as if herein fully set forth and is made a part hereof. <br />(f) The Special Use permitted herein shall only be effective so long <br />as the applicant or its successors operate the asphalt batch plant and/or concrete <br />batch plant in accordance with the aforesaid conditions. <br />The conditions set forth herein and in the order of March 19, 1982, <br />shall be binding upon the applicant or its successors in interest, and its <br />sublesses or its grantees. <br />The above and foregoing ORDER where inconsistent or different from <br />the provision of the Commissioner's ORDER entered on March 19, 1982, shall <br />supersede the provisions of said ORDER and shall be controlling. <br />ORDERED AND APPROVED by the Board of County Con¢nissioners of Elbert <br />County, Colorado, this day of ~/j/J,~~ 1983, to be <br />effective as of said date. <br />BOARD OF CO COMMI STONERS <br />enn A. art, airman <br />
