'_ • • RECEIVED <br />1?RUPUSED URDER AND RESULUL'IUN MAR 0 91983 <br />MINED V.ND RECLAMATION <br />The Board of (:ounty Coromissioners of Elbert County, C641'f~a4f8; ~i~uRAL RESOUacEs <br />public hearing held on February 2S, 1983, at the hour of 2:3U o'clock p.m. <br />reviewed and received testimony concerning an application for authorization to <br />operate an asphaltic hoY. mix plant and a concrete hatching plant on agricul- <br />tural zoned property in Elbert County. The application was submitted by Terra <br />Construction Company. <br />A review of the application discloses that it was tiled with the Land <br />Use Department on January lb, 1983, pursuant to the special use review provisions <br />of Section 12 of the Elbert County UtticialLoning Regulations. Publications of <br />the notice of hearing setting forth the date and time of the hearing were <br />accomplished by publishing same in a newspaper of general circulation in accordance <br />with County rules and regulations. <br />Testimony was taken both tram the applicant and tran citizens who <br />appeared at said hearing,. Exhibits were duly Tnarked and admitted, and the <br />Board being fully advised in the pranises, does, as required by Section 1'2.2 <br />of the Elbert County Uff:icial Zoning Regulations make the following findings: <br />1. Applicant has complied with all the public notice and public <br />hearing procedures as specified in Section XV11i.2 (1) as amended, of the <br />zoning regulations. <br />2. The Board has considered the unique conditions of the surround- <br />ing neighborhood, if any; the County-wide need for such use; the effect of <br />traffic to and trap the proposed use; the ettect and concerns of hazards to <br />surrounding areas, and the potential of possible damage to public roads; and <br />all other matters required to be addressed by the application. <br />3. The applicant has submitted a general plan for development which <br />indicates that the proposed operation would involve the removal of cobbles, <br />and other agriculturally unsuitable materials from areas in Elbert County as <br />well as the importation of some materials trap outside the County, the crushing <br />of these materials and the marketing of same. 1'he operation would be performed <br />through the use of currently manufactured equipment which is moveable in nature <br />and would be constructed on a parcel of land located in Section 28, Township b <br />South, Range 64 West of the bth P.M., County of Elbert, State of Colorado, and <br />would comprise an area of approximately 23.87 acres adjacent to a gravel pit <br />located in the NW 1/4 NE 1/4 of the same section. The proposed operation <br />would also involve potential impact to several Elbert County roads primarily <br />being Roads 174, 29, 21, 17-21, 186, and 166. 1'he applicant has proposed to <br />make certain modifications as required in connection with these roads and <br />also to provide maintenance for same in the general area of the proposed site. <br />
