However, the proposed operation was found to be in compliance after the applicant <br />produced a letter from the U.S.G.S. stating that the applicant was given permission to mine <br />up to the fault North of the present workings. Otherwise, the coal would be lost after retreat <br />mining began at O.C. #2. Furthermore, the mining plan submitted for this five yeaz term <br />included mining past the fault into coal in the lease block for which the application has been <br />made. The applicant was requested to submit an alternative plan for mining in case the <br />lease was not issued prior to permit issuance. A plan calling for retreat mining to begin after <br />the fault had been reached was submitted and found to be adequate. If the 120- acre lease <br />modification is granted, mining operations will continue until the year 2025. <br />January 18, (Permit Documents, Archive File) CMLRD Permit Renewal Document -This <br />document renews the Mining and Reclamation Permit for 5 more yeazs. This contains a <br />legal description for the 80 acres. <br />February 24, (Permit Review Correspondence File) OSM Permit Issuance -Contains <br />description of the 80 acre permit area. The 'boiler plate" portion of the approval contained <br />the following statement. <br />The permittee shall conduct underground coal mining and reclamation operations <br />only on those lands specifically designated as within the permit area on the maps <br />submitted in the complete application and approved for the term of the permit and <br />which are subject to the performance bond. <br />1984 <br />1987 <br />November 10, (Permit Review Correspondence File) OSM Memo recommending approval <br />of permit -This letter mentions U.S.G.S. written concurrence on February 10, 1981. BLM <br />concurrence January 30th and September 14, 1981. Attachment A-1 shows the 80 acres as <br />present permit boundary and the additional 120 acres as future permit boundary. This map <br />was taken out of the permit application. This document mentions that the public notice was <br />published. However the actual publication was for 200 acres that was published February <br />12 through March 5. This document also mentions that the review was a joint OSM and <br />MLRD review. <br />June, (Replaced pages in Permit Application) Page 3 of application submitted during a <br />transfer of operators lists acreage to be permitted as 200 acres. <br />3 <br />
