<br />1981 <br />January 29, BLM Memo to State Director -mentions that the 120 acres to be added to the <br />lease area exceeds the area of the original lease contrary to 43CFR 3432 and that <br />clarification is needed. Also this memo states that there are errors in the public notice in <br />Exhibit 12. Most importantly that the legal description totals 240 acres and not 120 acres. <br />February 10, Internal U.S.G.S. Memo -States that "the Ohio Creek No. 2 Mine is in <br />compliance with the Minerals Leasing Act and the 30 CFR 211 requirements." <br />February 18, U.S.G.S. Mine Plan Review submitted to the Ohio Creek Mine -This document <br />describes the area of the mine as being 80 acres. <br />March 5, (Exhibit 12, Permit Application) Copy of proof of publication of the mine's Public <br />Notice of submittal of permit application for 200 acres that was published February 12 <br />through March 5. <br />June 5, (Exhibit 6, Current Permit Application) MLRD Received a Mine Plan Map from <br />O.C. showing the "lease boundary" this boundary coincides with what is considered the <br />current (1992) permit boundary. This map shows active workings outside the "lease <br />boundary". <br />August 13, (Permit Review Correspondence File) Letter from MLRD to Colorado <br />Historical Society -This letter requests a review in Sections 15 and 16. The current permit <br />area is located in only in section 16. <br />December 11, (Permit Review Correspondence File) MLRD Proposed Decision to Approve <br />Mining and Reclamation Plan -Correct Legal Description is for 80 acres that is the "current <br />permit area". <br />December 11, (Permit Review Correspondence File) Public Notice -Joint MLRD / OSM <br />publication of public notice published December 17 through January 7. <br />October 29, (Permit Review Correspondence File) CMLRD Proposed Decision Document <br />and Findings -The Findings state that the mine is permitted for 80 acres and that the <br />operator has applied for lease modification to add an additional 120 acres. It stated that if <br />the "lease modification is not granted, the mine plan calls for retreat mining to commence <br />in 1983, with reclamation beginning in approximately the year 1993. If the lease modification <br />is granted, final reclamation will commence in the year 2025, following the completion of <br />mining". A legal description was not included proposed decision or findings. The Operations <br />Description portion of the Findings contained the following statement. <br />The Division was concerned that the mining plan map showed that the applicant would be <br />mining off the present Federal lease boundary into a Federal lease block for which it has <br />
