(Notification of denial shall be by letter, in cases where coverage under an allemate <br />general permit or an individual permit is required, instead of coverage under this gemerel permit.) <br />Automatic Coverage: If the applicant does not receive a request for additional information or a notification <br />of denial from the Divisioo dated within thirt}' days of the receipt of the application by the Divisioo, <br />authorization to discharge im accordance with the conditions of this permit shall be deemed granted. <br />c. Individual Permit Required: If, after evaluation of the application (or additional information, such as the <br />SWMP), it is found that this general permit is not applicable to the operation, then the application will be <br />processed es one for an individual permit. The applicant will be notified of the Division's decision [o deny <br />certification under this general permit. For an individual permit, additiomal information may be requested, and <br />180 days will be required to process the application and issue the permit. Tetttporary coverage tinder this <br />gemeral permit will be allowed until the individual permit goes into effect. <br />d. General vs. Individual Permit CoverttRe: Any owner or operator authorized by Wis permit tray request to <br />be excluded from We coverage of this permit by applying for an individual CDPS permit. The owner or <br />operator shall submit an individual application to the Division, with reasoms supporting We request. <br />e. Permit Certifications: The individual certification prepared for each applicant will indicate whether Part LE <br />of the permit which must be followed by that applicant. Part I.C must be followal by all permittees unless <br />exempted as outlined in Section III.C of the Rationale. (In the absence of such indication from the Division, <br />the permitlee will be responsible for determining amd they complying with the applicable sections in Pert I.) <br />In addition, all oerntitlees will be required to comply with Part I, subparts A, D, E and F, and all of <br />Pori ll of the permit. <br />6. Permit Exmiralion Date <br />Authorization to discharge under Otis general permit shall commence on October 1, 1992, and shall expire on <br />September 30, 1997. The Divisioo must evaluate and reissue this general perrnit once every five years, end must <br />also recertify the applicant's authority to discharge under the general permit al such lime. Therefore, any permittee <br />desiring continued coverege under the general permit must reapply by March 31, 1997. The Division will determine <br />if the applicant may com[inue to operate under the terms of the general permit. <br />An individual permit will be required for any facility not reauthorized to discharge under the reissued general permit. <br />For facilities wishing to terminate authorization under the new permit, provisioms of Part II.B.S.d will be applicable. <br />Inactivation of CetYificafion <br />The perntiuee may rroyuest inactivation of their certification under this permit, once the site has beam fully released <br />from their reclamation bond raquiremeots by the Colorado Division of Mining and Geology (CDMG). See Part <br />Q.B.S.d of the permit. <br />B. EFFLUENT LIMITATIONS AND CONDITIONS -PROCESS WATER DLSCIiARGE <br />;This section (I.B) only applies to facilities with a discharge of process water.) <br />General Limitations <br />a. There shall be no discharge of sanitary waste waters from toilets or related facilities. <br />b. There shall be no discharge of tloeting solids or visible foam in other then trace amounts. <br />
