Obviously, in your offices you simply allocated the money in the appropriate way --i.e., $350.00 to the River Pit and $50.00 to the Moon Pit. The Moon Pit was sold to Pat and Bonnie Weber in February of 1990. In its relationship with your office my client executed an Assignment Of Certificate Of Deposit, and their copy of that document (also signed by Pat and Bonnie Weber} indicates that the assignment was mailed with the Certificate Of Deposit in the amount of $2500,00 on February 16, 1990 to Ms, Deborah Mulloy of your Department. By letter dated February 12, 1990, my client sent various documeiite to Pat and Bonnie Weber, including the following; 1. Request For Transfer Of Mineral Permit And Succession Of Operator. 2. Financial Warranty. 3. Performance Warranty. 4. Assignment Of Certificate Of Deposit. 5. Limited Impact Operation - 110 Application Package. These items had been provided to the bank by your Division. From what you have told me, the Successor Of Operator application has never been filed by Mr, and Mrs. Weber, despite the fact that the bond is apparently in good standing. On October 2, 1990, I wrote your office concerning the payment cf the annual fee on the River Pit ill. I basically used Greg Williams' October 12th letter as a guideline and therefore there are a nurt~ber of errors contained in my October 2nd Letter. First, the permit number is wrong. The correct number is 77-44~~. It is not a No. 110 permit, it is rather a No. 112 permit (more them 10 acres). And the fee remitted is wrong. I remitted the sum of ;50.00 and the correct fee is $350.00. By the time you receive this letter, you should have received Binds in the amount of $350.00 from Greg Williams to satisfy the annual Eee requirement for the River Pit.
