<br />Anew category sought to locate the approximate location for storage <br />during quarry activities. While storage locations occur predomin <br />former Prelaw Affected Lands, their locations are subject to c <br />quarrying advances over the permit area over time. Due to the sever <br />disturbance of the Prelaw Affected Lands, storage of stone on Prela <br />safer due to the flatter profile on the hillside, while minimizing distu <br />Unaffected Lands. This is a major objecti a of the <br />approved Conversion Permit. Along with the measurements comes the initial <br />necessity for the Division to verify in the field the interpretation of th lands so <br />identified, and to adjust the financial warranty to reflect the actual ture and <br />extent of the disturbed lands. Tandem with this consideration is the nalization <br />of the manner and method of accounting that will allow the financial arranty to <br />'float' over the property, thereby encouraging concurrent reclamation. <br />The accounting system approved in the Conversion provides for the exclusion <br />of Prelaw Affected Lands from being included in the total of Affecte Lands to <br />be warranted for. Once verified in the field by the Division, the lands so <br />identified and measured will function as a credit toward the financi I warranty <br />on an acre for acre basis, or as otherwise determined, below. <br />For example: The initial warranty estimate could not take into a count the <br />Prelaw Affected Land in the estimate, since verification of the nature nd extent <br />of the Prelaw Affected Lands had not been completed on the grown ,pending <br />receipt of the revised aerial survey map. Once field veri ication is <br />accomplished, the Prelaw Affected Lands will no longer be include in the 25 <br />acres of Affected Land, as provided for in the Conversion. Assuming the entire <br />7.79 acres of Prelaw land is verified, this would reduce the 2 .63 acres <br />measured in the 1997 aerial photograph to 12.84 acres. Other acr s may be <br />factored out as well, as discussed further below, but for purpos s of this <br />example, assume that 12.84 acres of affected land will be acc unted for, <br />leaving a balance of 12.16 acres available for quarry expansion. <br />The warranty provided for under the Conversion was a gross es imate that <br />provided for 12 acres of extraction, with the balance comprising oads and <br />Marginally Affected Lands for a total of 18 acres.
