13. The Division must retain extra money in the event of vegetation failures in the <br />initial bond. If vegetation failures occur and all of the reseeding money was <br />spent for initial vegetation, the Division would not be able to remediate the <br />problem. After an applicant receives Phase II Bond Release, vegetative <br />establishment, the original reseeding amount is "returned" and only the <br />reseeding amount (for vegetative failures) is retained. This ensures that <br />adequate money remains for the ten-year liability period and that vegetative <br />success, including cover, production and diversity are achieved. <br />Task 158 -Yearly Site Maintenance and Pond Cleaning <br />14. Given BRL's analysis of their ponds, the Division agrees that the total number <br />of pond cleanings can be reduced to five during the liability period. <br />Task 210 -Reseed Unit Train Loadout and Coa- Stockpile Area <br />15. The Division will update the current reclamation cost estimate to reflect the <br />appropriate seed mix on page 2.05-25, Volume 7. <br />Task 203 Demolish and Remove Structures at Train Loadout <br />16. The current reclamation plan calls for removing all structures and debris from <br />the site, therefore, the cost for concrete disposal charges must remain. <br />There are a few general items that need to be kept in mind as one looks at the Division's <br />reclamation cost estimates. <br />The amount of the Division's reclamation cost estimates are, according to <br />Rule 3.02.2(1), to "assure the completion of the reclamation plan if the work <br />had to be performed by the Board..." The Division works under much <br />different guidelines than private companies. The biggest difference, which <br />accounts for government contracts usually being higher than those in the <br />private sector, is that the Division shifts all liabilities onto the contractor(s). <br />If there is a problem with the cut and fill volumes given or project delays or <br />changes are required due to ground (or beneath ground) conditions, the <br />burden of the increased cost is placed on the contractor. <br />For demolition estimates the Division uses costs from the Means guide. This <br />gives the Division a standardized cost to work with. While a specific <br />contractor may bid a lower amount, the Division must use the Means Guide <br />costs to remain neutral in the calculation of bonds. <br />
