<br />-z- <br /> <br />Exhibit D - Mining Plan <br />1. The text, page 2, states that recontoured slopes will be kept at <br />an average 2:1. Maps 4 and 7 show the finished grade of several <br />cross sections. The slopes on these cross sections are between <br />4H:1V and SH:1V given a 1" = 100' horizonal scale and a rise of <br />approximately 30 to 35 feet. Please clarify your final slope. <br />The 4H:1V slopes shown in Maps 4 and 7 are preferred by the <br />Division for revegetation success and erosion control. <br />Exhibit E - Reclamation Plan <br />1. The application states that "Some slope modification might occur <br />immediately offsite to the north to allow the creation of natural <br />contours and compliance with the finished grading plan. This <br />adjacent property is owned by Grand County and can be utilized". <br />Offsite disturbance, whether for mining or reclamation, is not <br />acceptable and cannot be approved by the Division. The applicant <br />must include all acreage to be affected as within the permit <br />boundary. Please submit a statement withdrawing the above plan <br />to affect acreage outside the permit boundary, or, submit new <br />acreage figures and exhibits that correctly show total acreage to <br />be affected. <br />2. The Division acknowledges that existing topsoil will be <br />stockpiled and that the applicant commits to obtain an alternate <br />source of topsoil to be replaced at a six inch depth. Please <br />clarify that topsoil will be replaced on both the pit area and <br />the recontoured slopes. <br />3. Rule 6.4 of the Mineral Rules and Regulations states that <br />"if topsoil is not replaced on a backfill area within a time <br />short enough to avoid deterioration of the topsoil, vegetative <br />cover or other means shall be employed so that the topsoil is <br />preserved from wind and water erosion, remains free of any <br />contamination by other acid or toxic material, and is a usable <br />condition for sustaining vegetation when restored during <br />reclamation." The Division requests a commitment to seed the <br />stockpile within a time period short enough to avoid <br />deterioration, which may be after several months or one growing <br />.season. The two year commitment the applicant makes may not <br />prevent deterioration to the stockpile. <br />4. The Division requests a commitment from the applicant to test the <br />topsoil prior to seeding and mulching to determine if fertilizer <br />is required and in what quantities. <br />5. Please submit a darker xerox of the "Nontechnical Soils <br />Description Report." The copy submitted is difficult to read. <br />One copy is sufficient. <br />
