The amendment application proposes the installation of a slurry wall around two (2) cells to <br />be developed into a water storage reservoir. No engineering designs or specifications or quality <br />control/quality assurance plan is provided. No contingency plan is provided in the event of <br />leakage in excess of the criteria established by the Office of the State Engineer (0.03 ft /day/ft ) <br />from either the slurry wall or pit floor. Prior to approval of the amendment application, the <br />applicant will need to complete one of the following options in conformance with Rule 6.4.4(c) <br />Option 1 <br />If testing for leakage has already been done, and the testing confirms that no exceedances of <br />Office of State Engineer (OSE) criteria have occurred, then the operator may submit a written <br />letter of confirmation from the OSE verifying that the slurry wall construction and water storage <br />reservoir is in compliance with their criteria. <br />Option 2 : provide the following information and commitment: <br />a statement from the applicant describing their plans for filling the reservoir, who will assume <br />responsibility for obtaining a permanent augmentation plan from the Office of the State Engineer, <br />and when such augmentation plan will be secured. <br />engineering designs &Jor specifications for slurry wall construction, including details of how <br />the slurry wall will be keyed into the pit floor. <br />a geologic evaluation of the pit floor and its suitability for a permanent water storage reservoir. <br />a contingency plan outlining how and when the operator will demonstrate the slurry wall and/or <br />pit floor limits leakage into the water storage reservoir in accordance with the criteria of the <br />Office of the State Engineer (OSE), and how the reservoir will be brought into compliance in the <br />event of an exceedance of the OSE criteria. <br />Weld County will commit to providing, within 30 days of DMG approval, a construction report <br />and a certification by a qualified engineer or professional that the slurry wall was installed in <br />accordance with the approved plans and specifications.
