<br />• Pate 4 <br />these areas. <br />flay 25, 2000 <br />The Division is prohibited by Rule 2.07.6(2)(e) from approving a permit revision unless the Division finds that <br />"the proposed operations will not adversely affect any publicly owned park or place listed, or eligible for listing, <br />as detemuned by the State Historic Preservation OtTcer, on the National Register of Historic Places, unless <br />approved jointly by the Board and the Federal, State, or local agency withjurisdictionovecthe park or place". <br />So that this item may be addressed expeditiously, we recommend that TCC implement the following course of <br />action: <br />1. TCC sends a letter to the Colorado State Flistorical Preservation Officer, requesting the SHPO provide a <br />written response to TCC indicating wfiether there are any: <br />(a) cultural and/or historic resources listed, or eligible for listing, on the National Register of Historic Places, <br />and <br />(b) significant I.Ttown archaeological sites, <br />existing within the following areas in TN, R86W: Section 11; W `/Z Section 13; N %:Section 14; Section <br />16; and the E % Section 17. <br />2. TCC provides a copy of the SHPO resporse to the Division as an Exhibit to the permit, along with proposed <br />permit text for insertion into the existing pemut pages 2.04-8 or 2.04-9 reflecting the responses provided by <br />the SHPO. <br />52. This item has not been adequately addressed. <br />The Division, in it's May 1, 2000 adequacy letter, requested TCC to insert, into existing permit page 2.04-12 <br />(dated 4/1/99), a "respotse" to Rules 2.04.6(lxa}(e). The response provided by TCC indicates that Rule <br />2.04.6(1) pertains solely to surface mining. This is incorrect. Rule 2.04.6(2) pertains to surface nvrung. Rule <br />2.04.6(3) pertains to underground mining. Rules 2.04.6(1)(a)-(e) pertain to all mining operations. <br />Please insert, on existing permit page 2.04-13 (dated 4/1/99), text that addresses a "response" to Rules <br />2.04.6(1)(a}{e). If the information required by Rules 2.04.6(1)(a}(e) may be found in other places within the <br />pemut, please indicate, for iruettion into the pemtit's text, where the information pertaining to each Wile <br />[(2.04.6(1)(a), 2.04.6(1)(6), etc] may be found elsewhere in the pemilt. It is recommended that this new text be <br />inserted into existing perrrtit page 2.04-12 (dated 4/1199), immediately following the phrase, "(e) Assist in the <br />preparation ofthe subsidence control plan under 2.05.6(6)", and immediately prL~ceding the phrase, "(2) Surface <br />Mining„ <br />55.
