liule 3.0..: - <br />The bond was evaluated during the Phase I bond release and the permit renewal process <br />in 1996. At that time, the bond was set at $1,817,911. Reclamation costs were estimated <br />at $972,309.00. Therefore, the Division holds adequate bond to complete reclamation. <br />Dces Kerr intend to submit a rider reducing the current bond from $5,500,000.00 to <br />$ I , 1817,91 1.00'? <br />Rule 4.03 <br />6. This rule requires that all roads be removed and reclaimed unless retention of the road is <br />approved as part of the post mining land use and the landowner requests, in writing, that <br />the road be retained. It is my impression that Kerr plans to leave the road to the <br />warehouse as a permanent road. It is labeled as a permanent light-use road on Map 28a. <br />However, I could not locate where the written request for retention of the road is. No <br />reference to a permanent road was found in section 816.156, S 16.166 or 816.175 of the <br />permit application. Please clarify if a road(s) will be retained, provide the required <br />landowner requests and update the permit if necessary. <br />Rule 4.05.6(LO) <br />7. MR-31 was approved on September 10, 1996. As part of this revision, Kerr committed to <br />update and submit "as-built" details on the appropriate map to the Division after the <br />installation of rip rap on Ponds A, D, and E was complete. The "as-built" designs could <br />not be located. To satisfy this requirement, either let me know which map they are on, or <br />submit the required certifications. <br />Rule 4.05.13(1) <br />8. The Maa Strip Mine hydrologic monitoring program is described on pages 780-L07 6b <br />through 780-110 of Volume 2. This plan says that three additional wells will be installed <br />in the pits as they are backfilled to monitor the establishment of a spoils aquifer. I see no <br />evidence that these wells have been installed, although the pits have been backfilled for a <br />number of years now. A plan and schedule for installing these wells is needed. <br />Rule 4.13 -Contemporaneous Reclamation <br />9. Mining ceased at the Marr Strip Pit in January 1993. The last coal was transported from <br />the loadout in September, 1996. A revised reclamation plan foc the loadout was <br />submitted to the Division on October l4, 1997, but it was withdrawn in July, 1998. To <br />date a revised plan has not been submitted.
