A revised reclamation plan for the loadout needs to be <br />submitted and approved so that reclamation of the loadout facility will be completed <br />during the 1999 field season. <br />Rule 4.14.6 - ReeradinQ or Stabilizing Rills and Gullies <br />10. After reviewing past inspection reports, [have noticed that several inspectors have noted <br />the presence of rills and gullies on the reclaimed azea and gully formation in the <br />permanent drainages. How does Kerr monitor rill and gully formation? <br />Ketr's permit says that when rills and gullies greater that 9" form, they will be blocked, <br />remulched and stabilized. The existing plan is based on a regulation that has been <br />revised, there is no longer a 9" depth requirement. Kerr may want to evaluate how rills <br />and gullies, in both the reclaimed area and in the drainage channels, are to be managed. <br />Rule 4. I S <br />l 1. Noxious weeds have been observed in the reclaimed areas at the Marc Strip Pit. In the <br />permit application, Kerr Coal Company says noxious plants as defined in Section 701.5 <br />will be controlled using the recommended methodologies of the Colorado State <br />University Extension Service. This part of the permit was approved in MR-12, July 5, <br />1991. Since that time a State noxious weed law has been passed. Each county has their <br />own list of noxious weeds that needs to be controlled. Don Stinson is the Weed <br />Coordinator for Jackson County (970-723-4091). A revised noxious weed control plan is <br />necessary. The plan should include the extent of infestation, the proposed chemicals, and <br />the timing of treatment. <br />12. Rule 4.15.1 requires that the revegetated areas are monitored. I could not locate the <br />revegetation monitoring plan in the permit and I have not seen the results of any <br />vegetation monitoring. Generally, the Division requests vegetation monitoring to be <br />conducted during years 3 and 5 after seeding. That way if there is a problem with the <br />original seeding effort, an azea can be reseeded without restarting the 10-yeaz liability <br />period. The permit needs to be revised to include a revegetation monitoring plan and to <br />submit the results to the Division. <br />13. Ken Coal Company has committed to graze the reclaimed areas in permit Sections <br />780. l8(b) and 816.11 S and most recently discussed in Minor Revision 24 which was <br />approved in July 1995. I have not seen any comments regarding the grazing plans at the <br />Marr Strip Mine since then. Please discuss. <br />14. Dates of revegetation aze depicted on the map submitted with the Annual Reclamation <br />Report.
