to discuss the concerns of the Division of Water Resources. <br />BRL submitted a water depletion estimate for PR-03 in their submittal dated August 30, <br />1999. The Division has forwarded [he estimate to the Office of Surface Mining (OSM) <br />with a request that OSM enter into consultation with the U.S. Fish & Wildlife Service. <br />The Division has not heard back from OSM yet. <br />The Division requested an update of BRL's response to the Colorado Division of Water <br />Resources letter. In the submittal dated October 4, 1999, BRL stated that a temporary <br />substitute supply plan (TSSP) will be submitted to the Colorado Division of Wa[er <br />Resources soon. The TSSP is an interim approval to begin operations while the company <br />is in the process of obtaining the necessary permanent approval from water court. <br />According to Chuck Roberts of the Colorado Division of Water Resources, the <br />application for the TSSP has not been received in their office as of October 2l, 1999. <br />Bond Estimate <br />31. The Division has not finished the review of the reclamation bond estimate. <br />The Division sent a copy of the Division's reclamation cost estimate to BRL on October <br />4, 1999. If this estimate is acceptable to BRL, please resubmit the estimate to the <br />Division. <br />ADDITIONAL QUESTIONS <br />37 The Division has spoken to BRL personnel previously abotd the potential problem wi[h <br />short circuiting of the proposed relocated pond B by having the primary discharge <br />structure too close to the pond inlet ditch on the west side. Short-circuiting could result in <br />sediment laden water entering the pond andgoing directly !o the discharge structure, <br />bypassing the rest of the pond. The Division is requesting that BRL modify the proposed <br />pond configuration so that the primary discharge structure is as far away from any of the <br />pond inlets as is possible. <br />In the submittal dated October 4, 1999, BRL revised Map No. 22-B showing a new <br />location for the primary discharge tube for relocated pond B. However, it appears that the <br />new location is very close to the east side pond inlet ditch.
