and 2.0~-7~i. In addition. BRL responded that only three of the four alluvial wells south <br />of proposed relocated pond B will be used. The fourth well will be plugged and <br />abandoned. Therefore, the maps submitted on August 30, 1999 are correct. <br />9. Because pond B will be relocated south of Old Highway 133, there tivill no longer be <br />alluvial monitoring wells downgradient of all of the disturbance. The present alluvial <br />tivells are all located north of the highway. Please propose locations for two alluvial <br />wells doxmgradient of the disturbance on the west side of the mine site. The sites should <br />be chosen with the intention of monitoring the potential effects to the ground water from <br />the disturbance related to the relocated pond and from contaminatiot: beneath the <br />relocated unlined pond. The well should be designed such that the perforated casing is <br />installed from the bnse of the alluvium and should be extended across the entire thickness <br />of the alluvial ag:tifer. Alluvial tivells AW-1, AW-2 and AW-3 should be stt~cient to <br />monitor any ground writer effects from the cool stockpile pad. <br />The Division has no further concerns. This response is discussed in item number 8 above. <br />11. Although the Old Highway 133 culverts are part of the hydrology designs jor the Bowie <br />No. 2 Mine, they will or do lie underneath the state highway. Please provide a written <br />acknowledgment from the Colorado Department of Transportation that the construction <br />is with their permission and that the maintenance of those highway culverts is the <br />responsibility of Bowie Resources. <br />The Division has no further concerns. BRL submitted a letter from CDOT, dated August <br />30, 1999, that states that CDOT grants permission to BRL to revise the culverts under old <br />State Highway 133. In addition, the submittal dated October 4, 1999 revised page exh-8- <br />31 to state that BRL will maintain the culverts under Old State Highway 133. <br />23. The U S Frsh & Wildlife Service, in a letter dated January I1, 1999, has waived the <br />depletion fee for the evaporative loss due ro the enlargement ojthe proposed relocated <br />pond B. However, no mention was made in Technical Revision No. 6 of additional <br />specifrc increases in water consumption. The Division is assuming that the increase in <br />water consumption of /83 acre feet per year, listed on proposed revised page 2.04-57, is <br />associated with Technical Revision No. 7. The Division would like to know if there will be <br />additionnl writer consumption due to other aspects ojthis technical revision, such as <br />water spraying of coal piles and the conveyor as well as washdown of the conveyor. <br />Also, the comment letter from Chuck Roberts of the Colorado Division of Water <br />Resources, which had been forwarded to BRL, refers to the water use plan jor Bowie No. <br />2 and asks if there will be any additions to the currently approved water consumption <br />plan dtte !o changes in evaporation or consumption.
