Sunnyside Gold Corporation (SGC) submits this permit Amendment request to modify
the post-mining land use (PMLU) for land and facilities (see enclosed map for affected
azea) within the American Tunnel MLR perrnit boundary to meet the attached request
from the property owner. The events leading to this modification request are explained
below.
The American Turmel permit area consists of 22.05 acres. Two areas of ownership exist
within the American Tunnel acreage. The County Road is the approximate dividing line
between these areas of ownership. The area to the east of the County Road has
historically had split ownership (the land belonging to others and the facilities belonging
to SGC) while the area west of the County Road is owned by SGC in total.
SGC recently fuialized a series of agreements complementing an Amendment to the
Consent Decree with CDPHE-WQCD. The terms of one of these agreements (Gold King
Agreement) involved transfer of the building ownership on the portion east of the County
Road to the property owner as well as all equipment used duectly for water treatment.
The owner's intention is to use the facility for an industrial purpose (ie treat water under a
CDPS permit). This agreement has been fulfilled and the owner is currently operating the
water treatment plant under a permit from CDPHE-WQCD that was transferred to Gold
King from Sunnyside.
