Amendment No.S <br />Page 2 <br />Other than the portal structure which has been removed, the remaining structures have <br />potential for beneficial use other than mining and aze within the azea of requested PMLU <br />change. SGC is currently leasing office and storage space in these facilities while Gold <br />King is using the water treatment portion of the facilities. <br />The terms of the second agreement affecting the American Tunnel permit azea (San Juan <br />Agreement) involves transferring ownership of the Herbert Placer and two unpatented <br />millsite claims (Gladstone and Bridge), which aze shown on the enclosed map. This <br />ownership transfer will occur after termination of SGC's Consent Decree with CDPHE. <br />The property position (west ofthe County Road) includes the lower quonset building and <br />access roads which already carries a PMLU of industrial to be left intact. The only <br />reclamation work contemplated by SGC (in the verbal description of the reclamation <br />plan) to complete reclamation in the azea west of the County Road was the removal of the <br />settling ponds by grading. The reclamation map in Amendment No.4 is inconsistent with <br />the verbal description and does not reflect their removal. With the anticipated long term <br />use of the settling ponds as part of a CDPS pemutted water treatment facility, SGC <br />believes the map is more reflective of the current intended post mining use of the land. <br />This is reflected by a third agreement between the two parties that will own the American <br />Tunnel permit azea in total in the near future (Gold King and San Juan). This agreement <br />provides for use of the ponds as part of the treatment facility. This use is no longer tied to <br />use of the facilities for SGC's mining operation but as a water treatment facility operated <br />by Gold King and should reflect that intended use. Therefore SGC also requests that the <br />permit PMLU of the treatment ponds reflect that use. <br />SGC believes this PMLU change is consistent with the long-term planned usage of the <br />property as a CDPS permitted facility and San Juan County land use policies (letter <br />attached).
