Thece are also outstanding staff concerns regarding this road and the staff <br />cannot recommend approval at this time. However, this road is again addressed in <br />[he permanent program submission and will be evaluated under that program. <br />The staff would recommend and request approval by the Board of the Trinidad Basin <br />amendment with the following stipulations: <br />1. The proposed haul road is specifically not approved at [his time. Remaining <br />staff concerns must be addressed and approval obtained prior to construction <br />of the road. <br />2. With regard to new structures -prior to the installation of any additional ditches, <br />ponds, or culverts, approval must be obtained from the Mined Land Reclamation staff, <br />subject to ratification by tl~e Board at the next regularly scheduled meeting. Suclr <br />approval must be obtained and construction completed prior [o any mining in areas <br />controlled by these structures. <br />a. With respect to culvert C-6, approval must be obtained and the culvert <br />installed prior to April 1, 1981. <br />b. With respect [o sediment control facilities at the rail loadout facility, <br />approval must be obtained and the structures installed by April 1, 1981. <br />3. With respect to the rail loadout faci.ity - at least fiFteen (15) days prior <br />to the installation of any water, sewer, or gas lines at t.'ie rail loadout <br />facility, Trinidad Basin hfining present Che staff with an adequate map <br />identifying the proposed location of these lines. <br />IC vas MOVED that the Board approve the amendment of Trinidad Basin Mining, Inc., <br />File No. 19-53, with the stipulations as indicated by the staff. SECONDED and <br />PASSED UNANIMOUSLY. <br />FOA THE RECORD: If the staff has not approved by March Board Meeting, the item <br />will 5e on the agenda at that Board Meeting. <br />AGENDA ITEM 47 - FLATIRON PAVING COMPANY, File No. 80-136 <br />Staff presentation was made by Reclamation Specialist, Jim McArdle, regarding <br />their 112 permit application for a sand and gravel operation, 149 acres, approxi- <br />mately one mile west of Eagle. Flatiron sent legal notice to the newspaper by <br />certified mail but the newspaper did not publish. All adjacent landowners were <br />notified. There are no other problems on [he application. Staff would recommend <br />approval of this permit application with bond set at $35,000 with the exception of <br />this publication problem. <br />It was MOVED that the Board, having heard the Flatiron Paving Company appllcation, <br />File No. 80-136, approve the permit, permit to issue with submission of bond in the <br />amount of 535,000 and direct Flatirun to publish for the next Board meeting a[ which <br />time the Board would ratify actions taken today. SECONDED and PASSED UNANIMOUSLY. <br />FOR THE RECORD: Publication notice should state [trot Che Board has approved the <br />permit subject to re-bearing at the Ptarch 25-26 board Meeting. <br />
