w <br />NRCS office in Delta, CO was consulted. United Companies requested that NRCS <br />recommend plants that can tolerate the high pH and salinity of this soil. <br />Mr. Glen Black, the landowner, has requested that the berni located at the south and <br />west boundary of the AM-1 area is increased in height. A Safeway store has been <br />constructed on the south side of Highway 92, across from his property. He <br />anticipates that the new store will generate more traffic and noise than previously <br />expected. He is also concerned that the lights in the parking area of the store will <br />present a light pollution problem at night. <br />Mr. and Mrs. Black are starting to build a house for themselves at the southeast <br />comer of their property adjacent to the Black Pit. Their belief is that a taller berm <br />will provide a better barrier for their home and recreational lake from the negative <br />effects of the new store and increased traffic. <br />A letter signed by Mc Black acknowledging that he wants to have the berm height <br />increased is attached to this Technical Revision. <br />If authorized the berm height will be raised by placing additional overburden topsoil <br />on the berm. A flat surface presently exists on top of [he berm. This flat area is <br />typically 15 feet wide. Additional material will be placed on this flat surface with <br />new berm slopes matching the existing berm slopes, 2H:1 V. The resulting berm will <br />have a triangular shape. Care will be taken [o limit soil spillage so that the toe of the <br />berm does not get any closer to the boundary fence to the south or west of the berm. <br />In light of this request, may United Companies delay revegetation work on the berm <br />until the request to raise the height of the berm at the south and west sides of the <br />property has been evaluated? <br />Problem 5: EncroachmenU50 foot buffer zone at north side of Black Pit <br />A number of items affect the north boundary of the Amendment l area and buffer <br />zone. These items are: <br />1. The fence is not the property boundary at the north side of the Amendment 1 <br />area. The actual surveyed boundary line is located to the north of the fence. <br />The distance separating the fence and the survey line varies. A sketch map of <br />the area is attached. <br />At the West end of the fence the separation between the fence and the <br />property line is greatest. The fence is 79 feet south of the property line. At the <br />S 1 /4 corner of Section 7 (located approximately 325 east from the west <br />boundary line of the Black property), the property line is located 6 feet north <br />of the fence. At this point the top of the Black Pit highwall is 47 feet south of <br />the property line, an encroachment of 3 feet into the 50 foot buffer zone. <br />4 <br />
