w M <br />At the Northeast corner of the Black Pit, the property boundary line is less <br />certain on the ground. Assuming that the property boundary and fence <br />coincide more closely at this location, the edge of the pit is 37 feet south of <br />the fence line, an encroachment of 13 feet into the 50 foot buffer zone. The <br />length of the North highwall, located near the NE corner of the pit, which has <br />been mined into the 50 foot buffer zone, is about 100 feet. <br />In summary, <br />a. At the northwest comer of the Black Pit no encroachment into the 50 <br />foot buffer zone has taken place (approximately 300 feet). <br />b. Approximately 470 feet of the highwall has encroached 3 feet into the <br />50 foot wide buffer zone. <br />c. At the Northeast corner of the Black Pit, a triangular shaped area has <br />been mined into [he 50 foot buffer zone (100 feet byl3 feet). <br />The total amount of encroachment appears to be about 2100 square fee[, if a <br />50 foot buffer zone exists at this boundary. The total area of the buffer zone is <br />43,500 square feet. Ninety five percent of the 50 foot buffer zone is in place. <br />2. The 50 foot buffer zone or setback from the affected land line appears to <br />originate in the Blacks' desire to have a barrier berm constructed at the south <br />and west sides of the Black Pit. This is stated in the second paragraph of <br />Exhibit D-Mining Plan portion of the Application for Amendment 1. <br />During a conversation between Mr. Black and a United Companies employee <br />on May 5, 2001 Mr. Black was surprised to hear that the buffer zone a[ the <br />North boundary area was 50 feet wide. He thought that it was 25 feet wide at <br />that area. Mr. Black told me that he is not concerned about damage to [he <br />dilapidated fence located at the North boundary of the Amendment 1 area on <br />his property. He agrees to a twenty five foot wide buffer zone at this area. A <br />letter signed by Mr. Black acknowledges the correctness of these statements. <br />A copy of this letter is attached to this Technical Revision. <br />3. The Blacks are in [he process of buying the Laughery property (AM 2 area) at <br />the present time. The Blacks have discussed the sale with Ms. Laughery and <br />have applied for a bank loan. If the Blacks buy the Laughery parcel, they want <br />to mine the area to [he maximum extent. At the conclusion of mining the <br />Blacks want to have a lake as depicted in the Alternate Reclamation Plan that <br />was included with the Reclamation Plan for AM-2 for this permit. In other <br />words, one lake. This intention is acknowledged in the letter mentioned in the <br />paragraph above. <br />United Companies requests that the 50 foot wide buffer zone at the north boundary of the <br />Amendment 1 east parcel be changed to a 25 foot wide buffer zone. <br />
