General Limitations <br />The following limitations apply to all di.rdutrges rovered by this permit: <br />1. Stormwaer discharges from the mining operation shall not cause or threaten to cause pollution, <br />romamination or degradation of any State waers. <br />2. Bulk storage smrcturcs for petroleton produces and other chemirols shall have adequate protection so as to <br />rontain all spills and preNem any ,spilled material from emering State waters. <br />3. No dumicaLs arc to be added to the ducitarge unless permission for tlu use of a specific chemical is grained <br />by tlu Division. In granting the use ojsuch chemicals, special ronditions and monitoring may be addressed <br />by separate letter. <br />4. AU dischargers must romply with .the lawful rcquirantnts of rounties, drainage districts and other state or <br />local agencies regarding any dudwrgrs of stormwaer to storm drain systems or other water nurser under <br />their jurisdiction. <br />B. SWMP Reauiremems <br />The SNMP (see Section V/1, aboHe) shall be prepared in accordance with goad engineering practices. The main <br />objectiNe of the plan steal! be to ident~ Best Management Practices (BMPs) which, when implemented, will meet <br />the terms and ronditionr of this permit. <br />Submittal of the SDVJNP is not automatically required under this permit. However, the Division reserve the right ro <br />require submiaal upon request, and to review the SWMP oral require additional measures to prevent and romrol <br />pollution. It is the Division's imem to request submission of such reports on a selective basis. <br />The following ronditions must be tact w achinr rompliance with this permit: <br />1. Cern'fttatwn oJSWMP Comp/edtrn and ImplemenlaHon: For actiHe mining operations misting on October <br />I, 1992, as soon as passible but no later than the anniversary date of their Mined Land Reclamation permit <br />that falls between July 1, 1993 and Juste 30, 7994, the permittee steal! have implanemed and be in <br />rompliance with their SWMP. (Set Part I.D.3 of the permit for the certiftcation language.) The certhcation <br />date for SWMP implementation has been txwrdinatd with the anniversary elate of the reclamation permit to <br />.,_ facilitate the review by CDMG and to rprtad oat the potential impact on the COMG. <br />For new active facilities (beginning operaions afln October 1, 1992), and for all other active facilities <br />applying afttrluly I, 1993, the SWMP shall be prepared prior to applying for roverage antler the general <br />permit. <br />For inaeAivt mining operationt applying before July 1, 1994, the pnmitttt shall have implanemed and be in <br />rompiiance with their SWMP as soon as passible but no later than July 1, 1994. For those applying after <br />July 1, 1994, the SWMP shall be prepared and rmplanented prior to applying for roverage under the general <br />permit. <br />2. Signatory Rtquircments: The pkm shall be signed in acrordance with Part LD.9 ojthe permit. <br />3. SWMP Rtvitw/Changes: Upon rcview ojthe SR'MP, the Division may nark the perminee at any time that <br />the plan dots nest mea one or more of the minimwn requironems of this part. After such not~caion, the <br />perminee will make changes to the plan. Unless otherwise provided by the Division, the pmnirret has 30 <br />days ttfter such nothcation to bah make the necessary changes to the pfan and to implement than. <br />
