F. Exemptions for Reclaimed Mints Mines that have met rntain reclamation ronditionr are not required to obtain a stormwatn discharge permit. Coo! mining opnations which m longer meet the definition of a reclamation area under 40 CFR 434.11 (I) because the performance bond issued to the facility by the appropriate SMCRA authority has been released are not required to obtain stormwatn distfiarge permits. Nan-roa! mining opnations which has~e been released from applicable state or Federal reclamation requirements aftn December 77, 1990 are also not required to obtain stormwatn discharge pmniu. The Division may designate such reclaimed sites as requiring a stormwater permit if the discharge is a sign cant rontributor of pollutams to warns of the State. /V COVERAGE UNDER ITdIS GENERAL PERMIT Under this general pmnit, opnators of stormwatn discharges associated with mineral mining activity may be granted aurhoriZation to discharge stormwatn imo waters of the Statc of Colorado. This permit doer not relieve the permittee from responsibility for rompliance with any othn applicable fednal, state or loco! law, rule, standard, ordinance, ordn, judgement or decree. Nor does this permit pre-empt or supnsede the authority of local agencies to prohibit, restrict or Cntrol drsdtargts of stormwatn to stormdrain systems or othn water rourses within their jurisdiction. Cert~cation undn the permit requires submittal oja romp/eted application. Upon receipt of all required information, the Division may albw or disallow ros+erage under the gencral permit within 30 days. V. CRITER/A FOR REQUIRING INDIVIDUAL PERMITS Various othn criteria can be used in valuating whethn or rot an individual permit may be required instead of a general permit. This information may rome from the application, SWMP, or additional information as requested by the Division, and includes, but is not Umited to, the following; 1. the quality of the receiving waters ~.t., the presence of downstream drinling warn intakes or a high quality fishery, or for preservation of high grraliry warn); 2. the type of mining activity, including pollution potential; 3. nc~ uolrune and type of mtueriaLs handled; 4. the size of the facility; S. evidence of nonrompGance under a previous permit for the opnation; and 6. the use of chemicals within the srormwatn system. In addition, an individual permit may be required whin the Division has shown or has reason to suspect that the stormwatn discharge is a sign~rom rontribwor of pollutants to waters ojthe State. Vl.
