Exemptions for Reclaimed Mints <br />Mines that have met rntain reclamation ronditionr are not required to obtain a stormwatn discharge permit. <br />Coo! mining opnations which m longer meet the definition of a reclamation area under 40 CFR 434.11 (I) <br />because the performance bond issued to the facility by the appropriate SMCRA authority has been released are not <br />required to obtain stormwatn distfiarge permits. Nan-roa! mining opnations which has~e been released from <br />applicable state or Federal reclamation requirements aftn December 77, 1990 are also not required to obtain <br />stormwatn discharge pmniu. The Division may designate such reclaimed sites as requiring a stormwater permit <br />if the discharge is a sign cant rontributor of pollutams to warns of the State. <br />/V COVERAGE UNDER ITdIS GENERAL PERMIT <br />Under this general pmnit, opnators of stormwatn discharges associated with mineral mining activity may be granted <br />aurhoriZation to discharge stormwatn imo waters of the Statc of Colorado. <br />This permit doer not relieve the permittee from responsibility for rompliance with any othn applicable fednal, state or <br />loco! law, rule, standard, ordinance, ordn, judgement or decree. Nor does this permit pre-empt or supnsede the <br />authority of local agencies to prohibit, restrict or Cntrol drsdtargts of stormwatn to stormdrain systems or othn water <br />rourses within their jurisdiction. <br />Cert~cation undn the permit requires submittal oja romp/eted application. Upon receipt of all required information, <br />the Division may albw or disallow ros+erage under the gencral permit within 30 days. <br />V. CRITER/A FOR REQUIRING INDIVIDUAL PERMITS <br />Various othn criteria can be used in valuating whethn or rot an individual permit may be required instead of a <br />general permit. This information may rome from the application, SWMP, or additional information as requested by the <br />Division, and includes, but is not Umited to, the following; <br />1. the quality of the receiving waters ~.t., the presence of downstream drinling warn intakes or a high quality <br />fishery, or for preservation of high grraliry warn); <br />2. the type of mining activity, including pollution potential; <br />3. nc~ uolrune and type of mtueriaLs handled; <br />4. the size of the facility; <br />S. evidence of nonrompGance under a previous permit for the opnation; and <br />6. the use of chemicals within the srormwatn system. <br />In addition, an individual permit may be required whin the Division has shown or has reason to suspect that the <br />stormwatn discharge is a sign~rom rontribwor of pollutants to waters ojthe State. <br />Vl.
