Exemption for Pre-ooerationa! Mints <br />Pre-operational mining sites are rwt required to obtain stormwater permits. The definition of active and inactive <br />mining sites do not include sires where mining claims arc being maintained prior to any disturbances associated <br />with the esrraction, benef~ciation, or pmotssing of mined materinls, nor sites where minimal activities are <br />undertaken jor the sale purpose of maimaining a mining claim. Sites at which only exploration has been conducted <br />are included in this aemption from stormwata ptrnit rcguirrmems. <br />However, as clarification, claims on land where thtre has been past evraction, beneficiation, or processing of <br />mining mattrial, but there is rorremly no active mining, are rouidaed inactive sites and are subject to <br />stormwattr regulation. <br />
