Volations/Penaltier <br />Dischargers of stormwater associated with mining activity, as defined in the EPA Stormwater Regulation (40 CFR <br />122.26(bJ(14J ~iiJ, which do not obtain coverage under This Colorado general pnmit, or undo an individual <br />CDPS permit regulating industrial stormwater, will be in violation of the federal Clean Water Act and the <br />Coorado Water Quality Control Act, 25-8-101 et aL Failure to romply with any CDPS permit requirement <br />constitutes a violation of the permit. Civil penalties jar violations of this CDPS permit or the Act may be up to <br />310,000 per day, and criminal pollution of state waters is punishable by fines of up to 525,000 Per day <br />1!!. STORMWATER D/SCNARCES ASSOCIATED WITH M1MNG OPERA77ONS <br />The Stormwater regulations require that stormwartr disdearger associated with certain industrial activities be covered <br />under the permit program. Mining operations were specifically included in the listed industrial activities. This general <br />permit is imendtd to cover stormwater discharger from mast metal mints. Ir is alto intended to temporarily rnver <br />stormwater discharges from oval mints which have individual ronvetuiona! CDPS permits. <br />A. De nitions <br />Mining operations include facilities classed as Standard Industrial Class cation Codes ]0 through 74 (mineral <br />industry), including active or inactive mining activities. This includes operations that have temporarily ceased <br />mining and arc in 'temporary cessation' staters with the Colorado Division ajMintrals and Geology. <br />Inactive mining operation are mining sites chat are not being actively mined. <br />B. Twes ofActivities Covered <br />This permit is intended to authorize mast new and existing discharges composed entirely of stormwater from mining <br />operations that are within SIC cede 10 -Metal Mining and Milling, at facilities that discharge stormwater only. <br />Stormwater is surfane runoff cnresed by preripitation including snawmelt runoff. The definition of stormwater <br />excludes infiltration. <br />This permit is ineended to cover those portions of a metal mining or milling site that are not already subject to <br />efi4uent limitations under 40 CFR 440. Those previously unrontralkd areas which discharge stormwater that <br />romes in comact with overburden, raw material, imermediate products, byproducts, finished products or waste <br />products may be rovered by this permit. <br />This permit is also ineended to temporarily cotrr existing discharges composed entirely of stormwater from any <br />other mining operations that are currently covered by an individual CDPS permits for discharge of process water. <br />At the time of rtissuanoe or amendment of the individual CDPS permit, ternu~ and Umitation from both permits will <br />be rombined into a new individual permit. Table I presents the cntegorier of the mineral industry and their CDPS <br />Stormwater permit coverage. <br />C Twes afActivitiu NOT Cotirred <br />This permit does trot authorize stormwater discharges from other types of regulated industrial activities.
