For example, a rnunty with a total population of om 100,000 is not eligible for nu Transportation <br />Act exemption, eHCn though the same musty may nor be required to obtain a municipal permit.) <br />Stormwater discharger associated with industrial activity (except for airports, steam electric power plants, or <br />uncontrolled sanitary landfrllsJ, that are owned or operated by o minor municipality are not required to apply for <br />or obtain a stormwater permit at this time. (Note: This exemption does not apply to other, pris+uety owned <br />industries within the same minor municipality.) <br />These facilities are not pnmanemfy exempted from the regulation, but are instead placed in Phase II of the <br />stormwtuer program. Phase II faclities, including minor municipalities, are currently under a moratorium, which <br />exempts them from permit requiremems under the stormwater program. It is expected that mr+rrzge will be <br />required at some future dare. <br />IV APPL/CA7TON AND CERTTFICA770N <br />A. Additional Aoalicotlan Reauinments <br />With the inclusion of atormwater provisions in this pmnit, the application requirements havr changed to some event <br />as well. /n addition to the application requiremems outlined in the previous permit, the following must also be <br />submined: <br />1. Description of stornrwater discharges, including drainage area <br />2. Description of present and proposed best managemem practicrs at site, including map. <br />3. Any existing water quality data on stormwater discharges. <br />4. For new facilities (beginning operations after October 1, 1992), and jar all other facilities applying aftn <br />July 1, 1993, aertifrcation as to the preparation of a SWMP. (See Section V.B.3.a ojthe Rationale for SWMP <br />mtifrcation requiremems for existing facilities applying on time. J <br />B. Permit Certifications <br />This permit is made up of several parts, some of which do not apply to all pnminees (i.e., while most faclitier wi/l <br />require covrrage under the stormwater section I. C, marry will Hat require coverage under the process water section <br />1.B). Therefore, the individual certification prepared for each applicam will indicate whether or not Part I.B of the <br />permit must be jolbwed by that applicant. In all cases (acept as noted in Section I/LC, above). Pan I.C must be <br />followed. (/n the absence of such indication from the Division, the pnmittee will be responsible for determining <br />and then complying with the applicable sections in Part LJ /n addition, all oermittees wall be required to comply <br />with Par! I, subparts A, D, E and F, and aB of Part ll of the permit. <br />V. TERMS AND COND/770NS OF PERMIT <br />A. Process Water Dsschages <br />Numeric Limitations: Numeric limits will be applied far some of the industrial categories covered by this <br />permit. These limits are from the EPA Federal Guidelines for the applicable poim source category, err follows: <br />a. Mineral mining and processing poim source category - 40 CFR 436 - subpart B (crushed stone), C <br />(construction sand and gravel), D (industrial sand), R (phosphate rock) -and all otha• industrial facilities <br />cosrred under SIC Code 14, except those spec~cally listed in paragraphs b and c be4~w, and concrete <br />
